ABSTRAK
Tesis ini dilatarbelakangi oleh adanya perbuatan Notaris yang tidak seksama dalam menjalankan jabatannya dengan seksama untuk membuat akta autentik. Notaris membuat Akta PPJB untuk Penghadap mantan suami dimana obyeknya berupa harta bersama yang belum dibagi setelah perceraian tanpa meminta persetujuan dari mantan isterinya. Sehingga dalam tesis ini dibahas mengenai analisis kedudukan PPJB tersebut, bagaimana akibat pembuatan PPJB dan bagaimana penerapan sanksi terhadap Notaris. Dalam hal ini dilakukan analisis terhadap perkara yang termuat dalam Putusan Majelis Pengawas Wilayah Notaris Provinsi DKI Jakarta Nomor: 02/PTS/MJ.PWN.Prov.DKIJakarta/III/2015. Jenis penelitian dari tesis ini adalah penelitian hukum dengan menggunakan bentuk penelitian yuridis-normatif dan tipe penelitian deskriptif. Adapun hasil yang diperoleh dari penelitian ini bahwa pembuatan PPJB tersebut melanggar syarat obyektif perjanjian sehingga PPJB tersebut batal demi hukum dan Notaris telah melanggar ketentuan Pasal 16 ayat 1 huruf a Undang-Undang Jabatan Notaris. Sanksi terhadap Notaris yang melanggar Pasal 16 ayat 1 huruf a tersebut adalah Peringatan tertulis, Pemberhentian sementara, Pemberhentian dengan hormat atau Pemberhentian dengan tidak hormat. Dalam pembuatan Perjanjian Pengikatan Jual Beli, Notaris sebagai Pejabat Umum harus menjalankan jabatan dengan teliti dan memeriksa dokumen-dokumen yang diperlukan untuk pembuatan Akta dan menolak apabila ada dokumen yang menjadi dasar pembuatan akta tidak lengkap. ABSTRACT
The background of this thesis is motivated by the careless acts of notary in carrying out his her official work in creating authentic deeds. The notary who has created binding Sale and Purchase Agreement Act for an ex husband, in which the object is in the form of a property that has not been divided after the divorce, and where the ex wife rsquo s approval was not asked upon. Therefore, in this thesis, a study is made in analyzing the position of Binding Sale and Purchase Agreement, the consuquenses of making Binding Sale and Purchase Agreement and how the sanctions is applied to the notary. In this case an analysis of the case contained in the Rulling of the Supervisory Council of Notaries Territory of Jakarta No. 02 PTS MJ.PWN.Prov.DKI Jakarta III 2015. This thesis uses the methods of legal research by applying normative juridical approach and using the descriptive type of research. The results from this research is that the making of Binding Sale and Purchase Agreement has violated the terms of the agreement objectives, where it was found to be null and void. The notaries have violated the provisions of Article 16 Paragraph 1 Letter a from the Notary rsquo s Profession Law. The sanctions are written warning, suspension, dismissal with respect or dismissal with disrespect. In the making of the Binding Sale and Purchase Agreement, the notary as Notary Public Officials have to carry out his her official work as a notary conscientiously and must examine the documents in the making of deeds, and reject if any deed is incomplete.
