ABSTRAK
Tesis ini membahas tentang hak yang dimiliki oleh ahli waris untuk memperoleh bagian warisan yang menjadi haknya. Hak yang dimaksud adalah hak menuntut hereditatis petitio sesuai Pasal 834 KUHPerdata. Terdapat berbagai macam hak menuntut, sehingga perlu diketahui lebih mendalam mengenai hak menuntut yang dimiliki ahli waris berdasarkan KUHPerdata. Berdasarkan studi kasus: Putusan Mahkamah Agung Republik Indonesia Nomor 789/PK/PDT/2010 terdapat sengketa waris yang harta warisannya dikuasai salah satu ahli waris, dimana gugatan diajukan oleh para ahli waris berdasarkan hak menuntut yang dimiliki. Metode penelitian normatif digunakan untuk mengkaji permasalahan dikaitkan dengan hukum positif yang berkaitan dengan hukum waris dan mengenai hak menuntut yang dimiliki ahli waris dalam sistem pewarisan. Hak menuntut seorang ahli waris terdiri dari hak menuntut ahli waris secara umum, yaitu hak menuntut bagian warisan dan hak menuntut menguasai harta warisan. Serta terdapat pula hak menuntut kepada sesama ahli waris, seperti hak menuntut terkait anak luar kawin diakui sah, hak menuntut terkait suami atau istri kedua, hak menuntut terkait pihak ketiga yang mewaris berdasar surat wariat, hak menuntut terkait batasan dan larangan dalam pembuatan surat wasiat serta hak menuntut pemisahan pembagian warisan. Proses hukum berdasarkan kasus diajukan tidak hanya berdasarkan 1 satu macam hak menuntut saja, melainkan didasari oleh beberapa macam hak menuntut yang dimiliki oleh ahli waris.

ABSTRACT
The thesis discussed regarding the rights owned by the heirs to have the inheritance they are entitled. The right is the right to sue hereditas petitio in accordance with the article 834 civil code. There are various kinds of the right to sue, so it is important to explore about the right to suing by the heirs based on civil code. Based on case study Supreme Court Decisions of The Republic of Indonesia Number 789 PK PDT 2010 there are inheritance dispute whose estate of inheritance controlled by one of the heirs, where a lawsuit filled by the heirs based on the possession of the right to sue. Normative research method used to asses the problem associated with positive law relating to inheritance law and about the right to sue by the heirs in the inheritance. The right to sue of an heir consists of the right to sue in general, which is the right to sue inheritance and the right to sue to take control of the estate of inheritance. There were also the right to sue to others heirs, such as related to children outside marriage, the second husband or wife, a testament to a third party, related to boundaries and prohition in making a testament and the right to sue separation the partition of an inheritance. The legacy process submitted not only based on 1 one kind of the right to sue, but based on some sort of the right to sue owned by the heirs.
