ABSTRAK
Tesis ini membahas tentang kewenangan Mahkamah Kehormatan Dewan DPR RI menurut Undang-Undang Nomor 17 Tahun 2014 tentang MPR, DPR, DPD, dan DPRD. Dengan menggunakan metode penelitian Yuridis Normatif, pendekatan dengan menggunakan teori Negara Hukum, Teori Demokrasi, Teori Perwakilan, Etika, Moral, dan Kode Etik, serta Teori Pengawasan. Adapun konsep-konsep yang digunakan adalah tentang kewenangan Mahkamah Kehormatan Dewan, Undang-Undang Nomor 17 Tahun 2014 tentang MPR, DPR, DPD, dan DPRD, dan hak imunitas Anggota DPR RI. Untuk mendapatkan kesimpulan dari tujuan penelitian, hal-hal yang disampaikan adalah terkait dengan sejarah pembentukan lembaga perwakilan di Indonesia dan pembentukan Alat Kelengkapannya, kode etik dan relevansinya terhadap Mahkamah Kehormatan Dewan, serta penjabaran mengenai tugas, fungsi, dan tata beracara Mahkamah Kehormatan Dewan sebagai lembaga penegak etik dan tata tertib DPR. Berdasarkan hasil penelitian diperoleh bahwa Mahkamah Kehormatan Dewan sebagai salah satu dari Alat Kelangkapan Dewan yang diatur dalam Undang-Undang Nomor 17 Tahun 2014 tentang MPR, DPR, DPD, dan DPRD merupakan lembaga penegak etik dan tata tertib bagi Anggota Dewan yang memiliki peran penting dalam menjaga dan memelihara citra dan wibawa Anggota Dewan. Namun kewenangan yang diberikan kepada Mahkamah Kehormatan Dewan dibatasi, sehingga kinerja dari lembaga ini tidak dapat maksimal meski tugas dan wewenangnya sudah dilaksanakan dengan baik. Kendala yang menyebabkan tidak maksimalnya kerja Mahkamah Kehormatan Dewan diantaranya karena keanggotaan dari Mahkamah Kehormatan Dewan berasal dari internal Anggota Dewan yang terdiri dari berbagai Fraksi, sehingga menimbulkan konflik kepentingan.

ABSTRACT
This thesis discusses the authority of the Committee on Ethics of the Parliament according to Law Number 17 Year 2014 on the MPR, DPR, DPD and DPRD. By using normative juridical research methods, approaches using the theory of the State of Law, Theory of Democracy, Representation Theory, Ethics, Moral, and the Code of Conduct, as well as the Theory of Control. The concepts used are about the authority of the Conduct Council, Law Number 17 Year 2014 on the MPR, DPR, DPD and DPRD, and the right of immunity Member of Parliament. To get the conclusions of the research objectives, things delivered is related to the history of the establishment of representative institutions in Indonesia and the establishment of complementary Organs of DPR, code of ethics and its relevance to the Committee on Ethics, as well as the elaboration of the duties, functions and procedures of litigation the Conduct Council as an institution enforcement of ethics and rules of procedures. The result showed that the Committee on Ethics as one of DPR permanent organs stipulated in Law No. 17 Year 2014 on the MPR, DPR, DPD and DPRD an enforcement agency of conduct and rules of procedures for the Members have an important role in maintaining and maintain the image and authority of the Members. But the authority given to the Committee on Ethics is limited, so that the performance of these institutions can not be maximal even though its duties and powers already implemented. Obstacles that have not maximal work of the Committee on Ethics such as the composition and membership of the Conduct Council Members come from internal sources consisting of various factions, giving rise to a conflict of interest.
