ABSTRAKKewenangan DPD dalam pembentukan undang-undang telah diatur pada Pasal 22D UUDNRI 1945, Undang-Undang Nomor 27 Tahun 2009 serta Undang- Undang Nomor 17 Tahun 2014. Undang-Undang Nomor 27 Tahun 2009 (UU MD3 2009) menempatkan kedudukan DPD tidak setara dengan Presiden atau DPR dalam hal pembentukan undang-undang. Lahirnya, putusan MK Nomor 92/PUU-X/2012 telah merubah kedudukan dan kewenangan DPD dalam hal pembentukan undang undang yaitu dengan merumuskan bahwa DPD ikut terlibat
sejak tahap pengajuan undang-undang sampai dengan sebelum diambil persetujuan bersama oleh DPR dan Presiden. Pembentukan Undang-Undang Nomor 17 Tahun 2014 (UU MD3 2014) yang tidak didasarkan pada putusan Makamah Konstitusi Nomor 92/PUU-X/2012 mengakibatkan ketidakjelasan kewenangan DPD dalam proses pembentukan undang-undang. Sehingga, diajukannya pengujian formil dan materiil atas UU MD3 2014 yang kemudian melahirkan putusan MK nomor 79/PUU-XII/2014, membuktikan bahwa UU MD3 2014 tidak dibentuk berdasarkan arahan dari putusan MK nomor 92/PUU-X/2012
karena mengatur kembali hal yang telah dinyatakan inkonstitusional oleh MK pada Putusan MK Nomor 92/PUU-X/2012. Terlebih lagi, terdapat beberapa aturan lainnya pada UU MD3 2014 yang bertentangan dengan putusan MK Nomor 92/PUU-X/2012 yang seharusnya dinyatakan inkonstitusional bersyarat oleh MK pada Putusan MK nomor 79/PUU-XII/2014.

direction of the Constitutional Court decision number 92 / PUU-X / 2012 as set back the has been declared unconstitutional by the Constitutional Court in Constitutional Court Decision No. 92 / PUU-X / 2012. Moreover, there are several other rules on MD3 Act 2014 contrary to the decision of the Constitutional Court Number 92 / PUU-X / 2012 that should have been declared unconstitutional by the Constitutional Court conditional on Court Decision number 79 / PUU-XII / 2014.
