Untuk memacu pertumbuhan dan perkembangan industri perbankan syariah diterbitkanlah Undang-Undang (UU) no 21 tahun 2008, dimana pada pasal 68 ayat 1 mengatur tentang pemisahan unit usaha syariah menjadi bank umum syariah. Semenjak keluarnya undang-undang ini, regulator kemudian mendorong beberapa unit usaha syariah untuk memisahkan diri dari bank induk konvensionalnya.Penelitian ini bertujuan untuk melakukan suatu evaluasi komprehensif atas kebijakan pemisahan sebagaimana yang terdapat pada UU No. 21 Tahun 2008 Pasal 68 ayat 1. Evaluasi komprehensif yang dilakukan ialah: evaluasi kelayakan kriteria pemisahan; analisis pengaruh tipe pemisahan terhadap kinerja BUS hasil pemisahan; evaluasi kinerja BUS hasil pemisahan ditinjau dari dana pihak ketiga, aset, dan pembiayaan; analisis kebijakan pemisahan UUS menjadi BUS secara komprehensif dari sisi teori, nasabah, dan regulator; merumuskan rekomendasi kebijakan. Teknik analisis yang dipergunakan ialah teknik ARIMA, difference in difference, dan deskriptif-kualitatif.Hasil peramalan menunjukkan bahwa tidak ada satupun bank sampel yang mampu mencapai 50% proporsi aset dari bank induk konvensionalnya. Hasil empiris lain menunjukkan bahwa tipe pemisahan tidak memberikan perbedaan terhadap aset, pembiayaan, dan dana pihak ketiga. Selain itu, hasil empiris menunjukkan bahwa kebijakan pemisahan tidak memberikan perbedaan terhadap aset, pembiayaan, dan dana pihak ketiga. Hal ini menunjukkan kebijakan pemisahan yang didorong oleh regulator harus dievaluasi mengingat skala ekonomi dari UUS yang masih kecil, terutama UUS yang dimiliki oleh Bank Pembangunan Daerah (BPD). Apabila tidak dilakukan perlakuan khusus terhadap UUS dan BUS yang sudah pisah, maka dalam beberapa tahun ke depan industri perbankan syariah dapat menurun drastis pertumbuhannya.

To accelerate the growth and development of Islamic banking industry in Indonesia, there established the Law Number 21 of 2008. In this Act at Verse 68 point one regulated about the Islamic business unit spin-off into full pledge Islamic banks. After the establishment of this Law, the regulator forced some Islamic business unit to spin-off from their parents.The aim of this research is to do a comprehensive evaluation of spin-off policy according to the Law No. 21 of 2008 verse 68 (1). The purposes of this study are: First, to evaluate the of spin-off criteria. Second, to analyze the impact of spin-off type on spin-off banks. Third, examine the impact of spin-off policy on the spin-off?s banks performance. Fourth, comprehensive analysis on spin-off policy from theory, customer, banker, and regulator. Fifth, formulate the policy recommendation. This research is using ARIMA, a difference in difference analysis and descriptive qualitative.The result shows that there are no sample banks can achieve 50% share asset from its parents. The other result indicates that the spin-off?s type doesn?t give differences in performance. Besides that, this research also suggests that the spin-off?s policy doesn?t provide a difference in asset and third party funds, but there are differences in financing. This result implies that the spin-off policy that imposed by the regulator should evaluate. Because the small of economic of scale from Islamic business unit, especially that owned by regional development bank. The regulator should pay particular treatment to Islamic business unit and spin-off?s bank.
