ABSTRAKPenelitian ini mengangkat permasalahan dalam Putusan Mahkamah Konstitusi No. 27/PUU-IX/2011. Menggunakan metode penelitian hukum normatif dengan pendekatan UU untuk permasalahan pertama, serta penelitian hukum empiris untuk permasalahan kedua. Dengan lahirnya Putusan Mahkamah Konstitusi No. 27/PUU-IX/2011, maka menimbulkan permasalahan baru karena melegalkan prinsip outsourcing dan hubungan kerja yang salah selama ini dalam outsourcing melalui mekanisme penyediaan jasa pekerja. Selain itu, Putusan tersebut bertentangan dengan kewenangan Mahkamah Konstitusi sebagai negative legislator serta bertentangan dengan asas kepribadian dalam perjanjian. Dalam praktek Putusan ini tidak dilaksanakan, alasan utamanya adalah karena belum adanya UU yang mengatur sebagai tindak lanjut dari suatu putusan Mahkamah Konstitusi. Sebagai saran, seharusnya pemerintah segera membuat UU terkait tindak lanjut dari Putusan Mahkamah Konstitusi dengan catatan memperbaiki prinsip outsourcing dan hubungan kerja yang salah dalam penyediaan jasa pekerja.
ABSTRACTThis study raised the problem in Constitustional Court rsquo s Verdict No. 27 PUU IX 2011. Using the normative law method with enactment approach for the first problem, and empirical law research for the second one. With the birth of the Constitutional Court rsquo s Verdict No. 27 PUU IX 2011, new problems are arisen because it is permitted outsourcing principal and incorrect work relationship of outsorcing through the mechanism of the service provider. Beside, the Verdict against the Constitutional Court rsquo s authority as negative legislator and also against the personality principal in an agreement. In practice, the Verdict is not enforced, the main reason is because there isn rsquo t enactment yet that sets as the follow up of a Constitutional Court rsquo s Verdict. As a recommendation, the government should immediately forms an enactment as the follow up for this Verdict, with some notes to repair the outsourcing principle and incorrect work relationship in a service provider.
