ABSTRAK
Permasalahan dalam Penulisan tesis ini adalah kekuatan sertipikat yang diterbitkan tidak sesuai dengan prosedur yang ditentukan dalam peraturan perundang-undangan yang berlaku dan perlindungan hukum yang diberikan oleh negara kepada pemegang hak atas tanah bekas hak milik adat berdasarkan peraturan perundang-undangan yang berlaku. Penulisan Tesis ini menggunakan metode penelitian berbentuk yuridis normatif dengan sumber data sekunder dan metode analisis data kualitatif. Sertipikat tetaplah sebagai alat pembuktian yang kuat bagi pemegangnya selama tidak dibuktikan sebaliknya. Meskipun dalam penerbitanya tidak dilaksanakan kegiatan pendaftaran tanah secara lengkap. Perlindungan hukum yang diberikan negara kepada pemegang hak atas tanah bekas hak milik adat dapat dilihat dari alat bukti kepemilikan tanah bekas hak milik adat yang diakui oleh negara sebagai dasar untuk melaksanakan pendaftaran tanah, selain itu negara melindungi pemegang tanah bekas hak milik adat untuk dapat melakukan upaya hukum apabila terjadi sengketa terhadap tanah bekas hak milik adat tersebut.

ABSTRACT
The issues highlighted in this study is the strenght of the certificate which is issued contra to the procedures specified in the prevailing laws and regulations and the legal protevtion provided by the state to the ex costomary land ownership based on the prevailing laws and regulations. The study uses normative juridical reserch method with the secondary data source and qualitative data analysis method. Certificate is a strongest evidentiary tool for the holders as long as they are not proven otherwise. Althought there is nocomplete land registration during the issue, the legal protection granted by the state to holders of costomary land rights can be seen from the proof of ownership of ex costomary land rights recognised by the state as the basis for carrying out land registration. In addition, to protect ex costomary land owners to make legal remedy in case of dispute over the ownership of the ex costomary land.
