Lelang sebagai suatu lembaga hukum mempunyai fungsi menciptakan/mencairkan nilai suatu barang menjadi sejumlah uang dengan nilai objektif. Akan tetapi dalam praktik, gugatan baik pra lelang maupun pasca lelang sangat tinggi dan beragam motif yang melatarbelakanginya, salah satunya adalah penetapan nilai limit. Permasalahan dalam tesis ini adalah bagaimana keabsahan penetapan nilai limit yang menjadi tanggung jawab kreditor dan bagaimana perlindungan hukum terhadap debitor yang hasil penjualan lelang tanahnya berada di bawah harga pasar dan nilai jual objek pajak NJOP.Tesis ini merupakan hasil penelitian dengan metode yuridis-normatif, tipologi deskriptif, menggunakan data sekunder, melalui studi kepustakaan dan bentuk hasil penelitian deskriptif analitis.Kesimpulan dari tesis ini ialah Bahwa NJOP tidak dapat menjadi acuan untuk menentukan nilai limit dan nilai limit adalah sah selama dinilai oleh penilai atau penaksir. Peraturan Menteri Keuangan Nomor 93/PMK.O6/2010 Tahun 2010 tentang Petunjuk Pelaksanaan Lelang belum cukup melindungi debitor khususnya dalam hal penetapan nilai limit.Saran yang dapat diberikan dalam penelitian ini agar menghindari sengketa kepada debitor dan kreditor dalam perjanjiannya menambahkan satu pasal mengenai penunjukan penilai independen apabila terjadi sengketa dan perlu adanya suatu revisi Peraturan Menteri Keuangan tentang petunjuk pelaksanaan lelang dan juga sudah waktunya untuk dibuatkannya suatu Undang-Undang bagi profesi penilai di Indonesia.

Auction as a legal institution has the function of creating disbursing the value of a good into a certain amount of money with an objective value. However, in practice, both pre auction and post auction lawsuits are very high and various motives behind it, one of which is the determination of the limit value.

The problem in this thesis is how the validity of the determination of the limit value that is the responsibility of the creditor and how the legal protection against the debtor whose the sale of the land auction is below the market price and the tax object sales value.

This thesis is the result of research with juridical normative method, descriptive typology, using secondary data, through literature study and form of descriptive analytical research result.

The conclusion of this thesis is that the tax object sales value can not be a reference to determine the value of the limit and the value of the limit is valid as long as it is assessed by the appraiser or appraiser. Regulation of the Minister of Finance No. 93 PMK.O6 2010 Year 2010 concerning Guidelines for Implementation of Auctions has not adequately protected debtors, especially in terms of determination of limit values.

Suggestions that can be given in this research to avoid disputes to debtors and creditors in their agreement to add one article on appointment of independent appraiser in case of dispute and need a revision of Regulation of Minister of Finance concerning instruction of auction implementation and also it is time to make a law for profession Appraiser in Indonesia.
