ABSTRAK
Nama : Bobied GuntoroNPM : 1506697012Program Studi : Pasca SarjanaJudul : Penawaran Participating Interest Oleh Kontraktor Kontrak Kerja Sama Kepada Badan Usaha Milik Daerah Berdasarkan Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 37 Tahun 2016. Tesis ini membahas tentang penawaran dan pengelolaan Participating Interest 10 oleh Kontraktor kepada BUMD ldquo;PI 10 rdquo; baik pengaturan mapun implementasinya sebelum maupun sesudah Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi, khususnya sejak diterbitkannya Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 37 Tahun 2016 tentang Ketentuan Penawaran Participating Interest 10 sepuluh persen Pada Wilayah Kerja Minyak dan Gas Bumi ldquo;Permen ESDM 37/2016 rdquo; . Penawaran PI 10 sebelum diterbitkannya Permen ESDM 37/2016 belum memberikan manfaat yang optimal bagi kepentingan nasional atau daerah. Belum optimalnya penawaran PI 10 tersebut dikarenakan pendanaan yang dibutuhkan untuk pengambilan PI 10 cukup besar, sehingga pada akhirnya Pemerintah Daerah atau BUMD bermitra dengan Badan Usaha swasta dengan pola bagi hasil yang tidak menguntungkan bagi BUMD dan berpotensi menimbulkan moral hazard dalam pengelolaan PI 10 . Tesis ini menggunakan penelitian yuridis normatif karena menitikberatkan pada penelitian kepustakaan yang intinya meneliti asas-asas hukum, sistematis hukum, dan sinkronisasi hukum dengan cara menganalisanya. Terbitnya Permen ESDM 37/2016 dapat menjadi terobosan tidak hanya untuk mengatasi permasalahan penawaran dan pengelolaan PI 10 kepada BUMD, yaitu bagi kemandirian kemampuan keuangan BUMD, kepastian hak Pemerintah Kabupaten, Pemerintah Provinsi, dan antar Pemerintah Provinsi, namun juga dapat mendukung solusi permasalahan perizinan daerah. Terobosan-terobosan yang dilakukan tersebut secara legalitas formal perlu diberikan landasan hukum yang sesuai di tingkat peraturan yang lebih tinggi sehingga memenuhi landasan yuridis dari keberlakuan suatu peraturan perundang-undangan.Kata kunci: PI 10 , BUMD dan Kontraktor.

Name Bobied GuntoroStudent Number 1506697012Program Post GraduateTitle The Offering of Participating Interest by Contractor To The Local State Owned Company Under The Minister of Energy and Mineral Resources Regulation Number 37 of 2016.This thesis discusses about the offering and management of Participating Interest 10 by Contractor to BUMD PI 10 either under regulation or implementation before and after Law Number 22 Year 2001 regarding Oil and Gas, especially since the issuance of Regulation of Minister of Energy and Resources Mineral Power Number 37 Year 2016 concerning Terms of Participating Interest of 10 ten percent of Oil and Gas Contract Area ESDM Regulation 37 2016 . The offering of 10 PI prior to the issuance of ESDM Regulation 37 2016 has not provided optimal benefits for national or regional interests. The non optimal PI 10 is due to the funding required for 10 PI is high enough, so in the end the Regional Government or BUMD partnered with Private Enterprise with a profit sharing pattern that is unprofitable for the BUMD and potentially generate moral hazard in the management of PI 10 . This thesis uses normative juridical research because it focuses on literature research that essentially examines the principles of law, systematic law, and legal synchronization by way of analyzing it. The publication of ESDM Minister 37 2016 can be a breakthrough not only to overcome the problems of offering and management of 10 PI to BUMD, that is for the independence of BUMD 39 s financial capability, certainty of the right of the District Government, Provincial Government and inter Provincial Government, however also to support solution for local license problem. Such breakthroughs in legal perspective need to be given appropriate legal basis at higher regulatory level so as to fulfill the juridical basis of the validity of a regulation.
