ABSTRAK
Terdapat beberapa cara untuk melakukan pemindahan hak milik atas tanah, salah satunya ialah melaui jual beli tanah. Jual beli tanah sendiri merupakan cara yang paling sering digunakan oleh masyarakat dalam hal pemindahan hak milik atas tanah itu tadi. Lahirnya UUPA merupakan sebuah perwujudan dalam unifikasi hukum tanah nasional. Sebelumnya, hukum tanah di Indonesia memiliki beberapa pengaturan, diantaranya adalah menurut hukum adat dan hukum barat. Semenjak diundangkannya UUPA, maka hukum tanah barat menjadi tidak berlaku lagi sepanjang terkait bumi, air serta kekayaan alam yang terkandung di, kecuali ketentuan-ketentuan mengenai hypotheek. Keberlakuan UUPA sendiri berlandaskan hukum adat, termasuk jual beli tanah dimana dalam hukum adat menganut asas terang dan tunai. Asas terang dan tunai ini merupakan suatu syarat sah dalam jual beli tanah yang diadopsi dalam sistem hukum tanah nasional saat ini. Asas terang berfungsi untuk pembuktian terhadap pihak ketiga, sedangkan asas tunai ialah untuk pemindahan hak milik atas tanah itu tadi. Namun, terjadi ketidaksesuaian pemaknaan asas terang maupun tunai dalam sengketa tanah yang diputus melalui pengadilan. Ketidaksesuaian dalam pemaknaan kedua asas ini dikhawatirkan berujung pada ketidakpastian hukum. Oleh karena ketidaksesuaian pemaknaan itu pula menjadi timbul pertanyaan tentang bagaimana terjadinya suatu pemindahan hak atas tanah baik menurut hukum adat maupun menurut putusan-putusan pengadilan.

ABSTRACT
There are several ways to transfer property rights to the land, one of which is through the sale and purchase of land. Sale and purchase of land itself is the most commonly used by the community in terms of transfer of property rights to the land earlier. The birth of UUPA is an embodiment in the unification of national land law. Previously, the land law in Indonesia has several arrangements, among others are according to customary law and western law. Since the enactment of UUPA, the law of the western lands shall become invalid as long as the earth, water and natural resources contained in, except the provisions concerning hypotheek. UUPA 39 s own enforcement is based on customary law, including the sale and purchase of land which in customary law adheres to the principle of cash and carry. This cash and carry principle is a legitimate requirement in the sale and purchase of land adopted in the current national legal system of land. The principle of carry serves for proof against a third party, while the cash principle is for the transfer of property rights to that land. However, there is a discrepancy in the interpretation of the cash and carry principle in land disputes that are passed through the courts. Non conformity in the interpretation of these two principles is feared to lead to legal uncertainty. Because of the inconsistency of meaning, it also arises the question of how a transfer of land rights applies both according to customary law and according to court decisions.
