ABSTRAK
Skripsi ini membahas mengenai pertanggungjawaban rumah sakit terhadap dokter tamu serta kewenangan dokter yang dikaitkan dengan hukum kesehatan. Skripsi ini juga mengambil contoh kasus untuk dianalisis, yaitu putusan pengadilan negeri nomor 79/Pid.sus/2011/PN.Kd.Mn. yang berlanjut ke putusan kasasi dengan Nomor Putusan 1110K/Pid.sus/2012. Tidak bisa dipungkiri, dengan berkembangnya zaman maka penyakit-penyakit juga banyak bermunculan yang membuat pihak rumah sakit membutuhkan dokter dengan cara membuat kontrak kerja yang tidak menyulitkan mereka. Dalam penelitian ini yang menjadi permasalahan adalah munculnya praktik kedokteran tanpa adanya Surat Izin Praktik yang menurut Undang-Undang merupakan suatu pelanggaran. Tujuan penulisan skripsi untuk mengetahui dan membahas lebih lanjut mengenai kapan dokter dikatakan berkompetensi dan mendapat kewenangan dan bagaimana bentuk pertanggungjawaban rumah sakit terhadap dokter-dokter berdasarkan hubungan kerjanya. Metode penelitian ini adalah penelitian kepustakaan dengan tipe preskriptif. Hasil penelitian menyimpulkan bahwa pihak rumah sakit juga memiliki andil terhadap pelanggaran yang terjadi, karena dalam perekrutan dokter rumah sakit wajib memperhatikan Surat Izin Praktik dokter, jika terbukti seorang dokter tidak memiliki Surat Izin Praktik maka rumah sakit terbukti melanggar Undang-Undang Rumah Sakit karena memperkerjakan seorang dokter yang tidak memenuhi persyaratan praktik di suatu tempat.

ABSTRACT
This thesis discusses about the hospital 39 s responsibility to the visiting doctor as well as the authority of the doctor associated with the health law. This thesis also took the case to be analyzed, the case is Decision of The District Court Number 79 Pid.sus 2011 PN.Kd.Mn. and continue to the Cassation Decision Number 1110K Pid.sus 2012. It can not be denied, in tis globalization era then the diseases are also a lot of emerging that makes the hospital requires a doctor by making a contract work with the easy way. The issue in this research is the emergence of medical practice without the existence of a Practice License which according to the Act is a violation. The purpose of thesis is to find out and discuss more about when doctors are said to be competent and get the authority and what kind of responsibility of the hospital against doctors based on their contract type. This research method is literature research with prescriptive type. The results of the study concluded that the hospital also has a influence of the violations that occurred, because the hospital must pay attention to the doctor 39 s Practice License when they want to make a doctor recruitment, if a doctor does not have Practice License then the hospital proven to violate the hospital law for employing a doctor who does not complete the requirements of practice in that place.
