ABSTRAK
Skripsi ini membahas mengenai prinsip itikad baik dalam kontrak atau perjanjian kerjasama antara manajemen artis dengan artis dimana pihak manajemen artis pada umumnya menawarkan kepada pihak artis jasa untuk memasarkan karya atau ciptaan yang diciptakan oleh pihak artis dan oleh karena hal tersebut timbul suatu perwakilan. Ditemukan berbagai masalah yang disebabkan oleh posisi manajemen artis yang lebih kuat dibandingkan dengan posisi artis yang pada hakikatnya bertentangan dengan Prinsip Itikad Baik. Hal ini mengakibatkan terbentuknya klausula dalam kontrak tersebut yang mengatur mengenai pemberian kuasa atau perwakilan yang dilakukan oleh artis sebagai pemberi kuasa dan manajemen sebagai penerima kuasa dimana terdapat beberapa masalah dalam penjalanannya. Penelitian yang digunakan adalah yuridis normatif dan keseluruhannya dilakukan dengan metode penelitian kualitatif. Penelitian ini juga menggunakan bahan hukum sekunder yaitu bahan hukum yang memberikan penjelasan terhadap bahan hukum primer berupa hasil karya para ahli hukum berupa buku, hasil penelitian serta jurnal ilmiah. Bahan hukum sekunder merupakan bahan hukum yang paling banyak digunakan dalam penulisan ini. Bahan hukum ini meliputi buku, artikel ilmiah dan artikel di internet. Penelitian ini menunjukan bahwa terdapat ketimpangan antara posisi tawar antara pihak manajemen artis dan artis dalam kontrak yang ditawarkan oleh pihak manajemen artis guna mengelola karir artis. Hasil penelitian menyarankan bahwa perlu adanya kesadaran dari pihak artis agar mencegah serta menghindari berbagai kemungkinan yang dapat merugikannya dari segi ekonomis, serta kesadaran dari pihak manajemen artis agar memperlakukan artis secara adil.

ABSTRACT
This undergraduate thesis mainly discusses the application of the principle of utmost good faith between artist management services and artists where artist management generally offers artists, as authors of an artistic work and licensor, an agreement to use the services while in return receive a fair share of the economic right as licensee. There are several problematic issues within the contract, primarily regarding the bargaining position where the artist management has the upper hand in respect to the artists rsquo position which fundamentally nullifies the principle of utmost good faith. Secondly, problems arise regarding the power of attorney mentioned on several paragraphs in the contract where it is required for the artist to give the power of attorney to the artist management services in order to enter into third party agreements. This undergraduate thesis uses the juridical normative and qualitative method in addition with secondary legal data such as regulations relating to the issue, and legal literatures written by jurists as well as research journals. This undergraduate thesis expounds the losses caused by the lack of balance in bargaining positions reflected on the contractual agreement offered by artist management services which become a primary cause for material losses to artists. The purpose of this research is to offer legal awareness to artists before they enter into a contractual agreement with artist management services. It will also focus on delivering legal awareness for these artist management services to offer contractual agreements with utmost good faith.
