Tujuan penelitian ini adalah untuk mengkaji lebih dalam penerapan Teori Relativitas Schutznorm Theorie dalam hukum perdata Indonesia. Studi ini berfokus pada penerapan Teori Relativitas Schutznorm Theorie dalam hukum perdata Indonesia terkait dengan indikasi yang digunakan untuk membatasi tanggungjawab berdasarkan pasal 1365 KUH Perdata agar tidak diperluas secara tidak wajar. Penelitian ini mengkaji penerapan Teori Relativitas Schutznorm Theorie di Indonesia melalui putusan Nomor 16/PDT.G/2012/PN.PN.WT dan putusan Nomor: 24/PDT.G/2013/PN.PRA. Peneliti menggunakan metode penelitian normatif, yaitu meneliti hukum sebagai norma positif as it rsquo;s is written in the book dalam sistem perundang-undangan dan juga mengunakan studi kepustakaan dengan pendekatan normatif serta pengumpulan data melalui content analysis dari sumber data sekunder. Hasil penelitian ini menunjukkan bahwa perlu adanya penerapan teori relativitas Schutznormtheorie sebagai salah satu syarat di luar unsur-unsur perbuatan melawan hukum. Dalam analisis putusan Nomor 16/PDT.G/2012/PN.PN.WT majelis hakim menolak menerapkan teori relativitas Schutznorm Theorie karena penerapan teori ini tidak diindikasikan dalam pasal 1365 KUHPer. Akan tetapi, dalam putusan Nomor: 24/PDT.G/2013/PN.PRA majelis hakim menerima gugatan untuk sebagian dan menolak sebagian. Hasil penelitian ini menujukkan Teori Relativitas Schutznorm Theorie perlu diatur menjadi sebuah ketentuan hukum tertulis yang mengatur lebih lanjut batasan ruang lingkup perlindungan kepentingan pada Pasal 1365 KUHPer.

The purpose of this minithesis is to examine the application of Relativity Theory Schutznorm Theorie in Indonesian Civil Law regarding the indication used to limit liabilities according to Article 1365 Kitab Undang Undang Hukum Perdata, to not be expanded immoderately.

This mini thesis reviews the application of Relativity Theory Schutznorm Theorie through Verdict Number 16 PDT.G 2012 PN.PN.WT and Verdict Number 24 PDT.G 2013 PN.PRA. Researcher uses juridical normative method in conducting the research, from the law as a positive norm in the legal system, as well as literature study with normative approach, and collecting the information through content analysis from secondary data.

The result of this thesis shows that the application of Relativity Theory is important to be used as one of the requirements other than Act Against The Law. Furthermore, in Verdict Number 16 PDT.G 2012 PN.PN.WT, The panel of judges refused to apply Relativity Theory with reason that this theory is not indicated in Article 1365 in Kitab Undang Undang Hukum Perdata. On the other hand, Verdict Number 24 PDT.G 2013 PN.PRA shows that the panel of judges accept a part of the suit, and reject the claim. In conclusion, this minithesis shows that Relativity Theory Schutznorm Theorie needs to be arranged into a written rule which govern the scope of protection of interes in Article 1365 Kitab Undang Undang Hukum Perdata
