ABSTRAK
Kebijakan desentralisasi yang melimpahkan kewenangan pada kepala daerah untuk melakukan mutasi jabatan Aparatur Sipil Negara ASN berpeluang pada penyalahgunaan wewenang. Hal yang menjadi tantangan adalah peran strategis dan kekuasaan kepala daerah seringkali berorientasi pada tindakan-tindakan untuk menerapkan kewenangan diskresi sebesar-besarnya. Dalam penelitian terhadap kasus yang sama, hal tersebut mencerminkan apa yang disebut sebagai discretionary corruption. Hal ini ditegaskan oleh Lord Acton yang menyebutkan bahwa ldquo;all power tends to corrupt and absolute power corrupts absolutely rdquo;. Penulisan ini mencoba untuk menjelaskan tentang kerentanan penyalahgunaan kewenangan diskresi oleh kepala daerah dalam kasus mutasi jabatan ASN yang berpotensi pada kejahatan. Penulis menggunakan bad apple and bad barrel theory untuk menganalisis faktor-faktor yang menyebabkan kerentanan penyalahgunaan wewenang oleh kepala daerah dalam kasus mutasi jabatan ASN.

ABSTRACT
The decentralization policy through which the authority is being delegated to the head of district to conduct the Civil Servant mutation could potentially trigger the abuse of authority. The challenging thing is that the strategic role and power of the head of district become increasingly focus on the implementation in which the power is manifested excessively. In a study of the same case, it reflects what is called discretionary corruption. This is confirmed by Lord Acton who mentions that all power tends to corrupt and absolute power corrupts absolutely . This paper attempts to explain the vulnerability of abuse of discretion authority by the district head in the case of civil servant mutation which could potentially become crime. The author uses bad apple and bad barrel theory to analyze the factors causing vulnerability of abuse of authority by the head of district in civil servant mutation case.
