ABSTRAK
Penelitian ini meneliti bagaimana urgensi netralitas PNS dalam pilkada untukmewujudkan AUPB, dan melihat bagaimana permasalahan penerapan netralitasPNS dalam beberapa pelaksanaan Pemilihan Kepala Daerah (Pilkada).Berdasarkan hasil penelitian, terlihat bahwasanya Pilkada di berbagai daerah diIndonesia beberapa waktu kebelakang masih diwarnai dengan beberapapermasalahan dan sengketa pasca pilkada dilaksanakan, hal tersebutdilatarbelakangi berbagai hal dan yang spesifik berkaitan dengan penelitian iniadalah pelanggaran terhadap netralitas PNS dalam pelaksanaan Pilkada. Padahasil penelitian, terlihat dengan jelas bahwa netralitas PNS dalam pelaksanaanPilkada merupakan suatu hal yang sangat penting, hal ini termaktub dengan jelasdalam berbagai aturan yang mengatur secara rinci tentang PNS, antara lain dalamUU No. 5 Tahun 2014 tentang ASN dimana PNS harus bebas dari pengaruhgolongan maupun parpol, dan netralitas merupakan amanat yang ada didalamAsas Manajemen ASN. Selanjutnya Netralitas PNS sangat erat kaitannya dalammewujudkan AUPB, dimana didalam UU ASN telah disebutkan bahwa PNSharus netral, dan untuk mewujudkan tata kelola pemerintahan yang baik melaluiAUPB, diatur bahwa PNS harus netral dan tidak boleh berpihak sehingga denganpelaksanaan netralitas PNS dapat mewujudkan pelaksanaan AUPB. Selanjutnyamengenai pelanggaran netralitas PNS diatur sanksi hukuman sedang dan beratsebagaimana diatur dalam Disiplin PNS PP No. 53 Tahun 2010, dimana ancamanterberat PNS dapat diberhentikan dengan tidak hormat atas pelanggaran yangtelah dilakukan. Pelanggaran netralitas PNS di daerah marak diwarnai modus,antara lain Mobilisasi PNS, Mutasi PNS, Penyalahgunaan Anggaran, sertaintimidasi PNS. Pada akhirnya pasca dikeluarkannya UU ASN pengawasannetralitas ASN menjadi tugas Komisi Aparatur SIpil Negara (KASN), dengantugas yang demikian besar, KASN masih memiliki keterbatasan dibidangkewenangan, SDM dan anggaran. Sehingga kedepannya untuk meningkatkanpengawasan netralitas PNS diperlukan penguatan KASN dari berbagai aspektersebut, kemudian perlu diadakannya sosialiasi secara komprehensif kepada PNSdi seluruh daerah untuk melakukan prevensi terhadap berbagai pelanggarannetralitas PNS, dan terakhir perlu kiranya memanfaatkan teknologi informasiuntuk membuka pengawasan masyarakat terhadap PNS melalui pengaduanlangsung dengan sistem informasi, sehingga dapat mewujudkan pengawasannetralitas PNS secara efektif.

ABSTRACT
This research examines how urgency of civil servant neutrality in elections torealize AUPB, and to see how the problem of civil servant neutralityimplementation in some implementation of Election of Regional Head (Pilkada).Based on the results of the research, it appears that elections in various regions inIndonesia some time back are still colored by several problems and post electiondisputes implemented, it is motivated by various things and specific related to thisresearch is a violation of the neutrality of civil servants in the implementation ofelections. In the research results, it is clear that the neutrality of civil servants inthe implementation of Pilkada is a very important thing, it is clearly stated in thevarious rules that regulate in detail about civil servants, among others, in Law no.5 Year 2014 on ASN where civil servants should be free from the influence ofgroups and political parties, and neutrality is a mandate that exists within the ASNManagement Principles. Furthermore, the neutrality of civil servants is closelyrelated to the realization of AUPB, where in the ASN Act has been mentioned thatthe civil servants should be neutral, and to realize good governance throughAUPB, regulated that the civil servants should be neutral and should not takesides so with the implementation of the neutrality of civil servants can realize theimplementation of AUPB . Furthermore, regarding the violation of the neutralityof civil servants are sanctioned by medium and heavy punishment as stipulated inthe Civil Government Regulation PP. 53 of 2010, where the heaviest threat ofcivil servants may be dismissed with disrespect for the offenses committed.Violations of the neutrality of civil servants in rampant areas are colored bymodes, including Mobilization of Civil Servants, Mutation of Civil Servants,Budget Abuse, and civil servants intimidation. In the end, after the issuance ofASN Law, the control of ASN neutrality becomes the task of the State ApparatusForce (KASN), with such a large task, KASN still has limited authority, humanresources and budget. So in the future to improve the supervision of the neutralityof civil servants is needed strengthening KASN from various aspects, then needcomprehensive socialization to civil servants across the region to prevent theprevention of various violations of the neutrality of civil servants, and lastly needto use information technology to open the public surveillance of civil servantsthrough a complaint directly with the information system, so as to realize thesupervision of the neutrality of civil servants effectively.
