ABSTRAK
Salah satu fungsi pemerintahan negara dalam memelihara kemanan danketertiban masyarakat, menegakan hukum, melindungi mengayomi dan melayanimasyarakat, serta terbinanya ketentraman masyarakat dengan menjunjung tinggihak azasi manusia dalam kaitannya dengan sistem pemerintahan merupakan tugasdan wewenang dari Kepolisian Negara Republik Indonesia. Saat ini jumlahanggota Kepolisian di Indonesia sebanyak 430 ribu personel. Dari 430 ribupersonel Polri, 10 merupakan perwira dan 90 merupakan bintara dantamtama. Setiap anggota Polri dari pangkat terendah sampai pangkat tertinggimemiliki kewenangan melakukan diskresi kepolisian termasuk dalam penggunaansenjata api. Perkap No 1 Tahun 2009 telah mengatur mengenai pengunaankekuatan Polri dalam tugas penegakkan hukum dimana didalam beberapapasalnya tercantum prosedur penggunaan senjata api. Lokasi penelitian di lakukandi Polres Jakarta Pusat. Hasil penelitian didapati bahwa Personel Polri dilapanganbanyak yang belum memiliki pemahaman mengenai kode etik dan prinsip dasarpenggunaan senjata api dalam pelaksanaan kewenangan diskresi. Masih seringterjadinya abuse of power dalam penggunaan senjata api yang menimbulkanketakutan bagi masyarakat. Terjadinya multi intrepertasi di kalangan anggotaPolri yang melaksanakan tugas, fungsi dan wewenang kepolisian di lapangan.Pengetahuan yang dimiliki oleh anggota Polri di Lapangan berbeda-beda sehinggatindakan yang dilakukan dalam melakukan diskresi banyak yang tidak sesuaiprosedur.

ABSTRACT
One of the functions of state government in maintaining the security and publicorder, enforcing the law, protecting the nurturing and serving the society, and theestablishment of the tranquility of the people by upholding human rights inrelation to the governance system is the duty and authority of the Police of theRepublic of Indonesia. Currently the number of Police members in Indonesia asmuch as 430 thousand personnel. Of the 430 thousand Police personnel, 10 areofficers and 90 are NCOs and enlisted. Each member of the Police from thelowest rank to the highest rank has the authority to conduct police discretionincluding in the use of firearms. Perkap No. 1 Tahun 2009 has regulated the use ofpolice force in law enforcement duties where in some articles listed procedures offirearms use. The research location is done in Central Jakarta Police Resort. Theresults of the study found that many Police Personnel in the field who do not havean understanding of the code of ethics and the basic principles of the use offirearms in the exercise of discretionary authority. Still often the occurrence ofabuse of power in the use of firearms that cause fear to the public. The occurrenceof multi intrepertation among members of the Police who carry out the duties,functions and authority of the police in the field. The knowledge possessed bymembers of the Police in the Field is different so that the actions taken indiscretion do not fit the procedures.
