ABSTRAK
Penelitian ini bertujuan untuk menjelaskan penanganan penerapan HukumProgresif atas kasus pencurian 3 biji kakao oleh nenek Minah di wilayah PolresBanyumas. Penyidik Polres Banyumas, seharusnya tidak melihat kasus tersebuthanya dari hukum positif saja, melainkan harus juga melihatnya dari perspektifhukum progresif. Penegakan hukum sering mengingkari rasa keadilan. Penegakanhukum ini terlihat jika berhadapan dengan orang lemah, yang tidak mempunyaikekuasaan dan sebagainya, hukum bisa menjadi sangat tajam. Dari perspektifhukum progresif, maka kasus Nenek Minah idealnya tidak relevan sampai padaranah pengadilan. Bahkan, proses penegakan hukum tersebut selainmengeyampingkan rasa keadilan masyarakat, juga merupakan bukti bahwa kiblathukum di Indonesia adalah hukum positivime, tanpa memperdulikan dimensisosiologis yang ada. Penegakan hukum terhadap nenek Minah harus dilepaskandari unsur-unsur sosial serta moralitas, karena menurut kaca mata aliran ini tujuanhukum adalah kepastian, tanpa adanya kepastian hukum tujuan hukum tidak akantercapai walaupun harus mengenyampingkan rasa keadilan. Padaperkembangannya terkait dengan penegakan hukum, Polisi diminta untukmenggunakan falsafah integrasi solutif yang terdapat pada sila KeempatPancasila, yakni musyawarah yang merupakan prioritas utama untuk mencapaikebijaksanaan yang adil dan menciptakan perdamaian. Falsafah seperti itulahdalam hal ini bisa dijadikan alternatif atau cara lain peradilan kriminal denganmelakukan pendekatan integrasi atau pembauran antara pelaku dengan korban/masyarakat hingga menjadi satu kesatuan yang utuh untuk mencari solusi denganharapan dapat kembali pada suatu hubungan yang baik dalam masyarakatnantinya. Alternatif penghukuman inilah yang biasa disebut sebagai restorativejustice. Tidak ada salahnya polisi mencoba menggunakan kewenangannya melaluipenerapan keadilan restorative atau restorative justice. Keberanian polisimenerapkan keadilan restorative justice diperlukan, agar Polri tidak selaludisalahkan dalam menangani suatu kasus, yang menurut masyarakat telahmencederai hukum itu sendiri. Tidak ada kepentingan umum yang terganggu jikapenyidik melakukan Diskresi. Polisi juga sebenarnya dapat melakukan DiskresiPemidanaan kalau memang alasan dari pihak perkebunan kakao PT. Rumpun SariAntan RSA IV Darmakradenan hanya untuk memberi efek jera. Bagi masyarakatmiskin, dibawa ke kantor polisi saja mereka sudah ketakutan dan bisa menimbulkan efekjera.

ABSTRACT
The purpose of this research is to describe the handling of the application ofprogressive law on the three cacao beans theft case perpetrated by GrandmaMinah in the jurisdiction of Banyumas resort police. The Banyumas resort policedetectives should not regard the case solely from the standpoint of positive law,but must also regard it from the progressive law perspective as well. Lawenforcement often denies sense of justice. This law enforcement is visible whendealing with the weak, the ones who lack power and the like, in which downwardlaw is greater. From a progressive law perspective, ideally Grandma Minah rsquo s casehas no relevance to reach the court. In fact, in addition to ruling out thecommunity sense of justice, the law enforcement process is also proof that thelegal direction in Indonesia is legal positivism, without taking heed of the existingsociological dimension. Law enforcement against Grandma Minah must bedetached from social elements and morality because according to this genre, thepurpose of law is certainty. Without legal certainty, the purpose of law cannot beachieved even though sense of justice must be put aside. In its developmentrelated to law enforcement, the police force are asked to use the philosophy ofsolutive integration contained in the Fourth Principle of Pancasila, which isdeliberation as the first priority to gain fair wisdom and create peace. Suchphilosophy in this case can be an alternative or other means of criminal justice byapplying the integration approach or assimilation between offenders and theirvictims society until they become a unified whole in order to search for a solutionin the hope of repairing the relationships in the community eventually. Suchalternative punishment is called restorative justice. It does no harm for the policeforce to try to exert their authority through the application of restorative justice.The police force should have courage to apply restorative justice so that theIndonesian police are not always to blame in handling cases, which society deemsas harming the law itself. If detectives use discretion, public interest is notdisturbed. In fact, police can also exercise Criminal Discretion if indeed themotivation of cocoa plantation PT.
