Tesis ini meneliti aturan pasal 17 huruf f UUJN Perubahan yang mengatur notaris dilarang merangkap jabatan sebagai pegawai swasta. Larangan tersebut bertujuan untuk mencegah terjadinya benturan kepentingan agar notaris tetap independen dan netral. Penelitian ini mengangkat beberapa pokok permasalahan yaitu pertama tanggung jawab notaris akibat melakukan rangkap jabatan, mengenai otentisitas akta yang dibuat notaris yang melakukan rangkap jabatan, peran MPD menindaklanjuti notaris yang merangkap sebagai pegawai swasta. Penelitian ini menggunakan metode penelitian yuridis normatif, yaitu penelitian keseluruhan data sekunder hukum, digunakan untuk menganalisis peraturan perundang-undangan jabatan notaris, buku, dan artikel yang relevan dengan permasalahan yang akan diteliti.Hasil penelitian menunjukkan pertanggungjawaban notaris akibat menjalankan rangkap jabatan sebagai pegawai swasta yang mengakibatkan aktanya hanya mempunyai kekuatan pembuktian sebagai akta dibawah tangan dapat menjadi alasan bagi pihak yang menderita kerugian untuk menuntut penggantian biaya, ganti rugi dan bunga. Terkait sanksi administratif, sesuai Pasal 12 huruf d dimana notaris tersebut dikenakan sanksi pemberhentian dengan tidak hormat. Mengenai otentisitas akta yang dibuat notaris yang melakukan rangkap jabatan sebagai pegawai swasta akta tersebut hanya memiliki kekuatan di bawah tangan. Peran majelis pengawas daerah menindaklanjuti notaris yang menjalankan rangkap jabatan adalah memanggil notaris untuk menyelenggarakan sidang memeriksa dugaan pelanggaran kode etik notaris atau pelanggaran jabatan notaris.

AbstractThis thesis about article 17 letter f on the law of Notary rsquo s occupation asserted that notary forbidden to performing double profession as employee at private company. On this research, author raise some main issues, first one is how the responsibility of notary who performing double profession as employee at private company. The second is authenticity of deed made by notary who performing double profession as employee at private company. The last is what is the role of the district chamber of notary supervisory in addressing a notary who performing double profession as employee at private company. This research using the methodology of juridical normative it means this research viewed from the normative side which is research in the secondary data law used to analyze various regulations in the field of notary occupation, the field of civil law, books, articles that still relevant with the problems that will be researched.The result of this research indicates that a notary who performing double profession as employee at private company will cause a deed the notary made only had a proofs as the underhand certificate or become a void by law can be the reason for parties who suffer the loss to demand reimbursement of the cost , compensation and interest to the notary. While the administrative sanctions the notary will get is dismissal. The last is role of the district chamber of notary supervisory is to do the notice towards the notary in order to hold a hearing to check the alleged violations from code of conduct of the notary or violation of the implementation of notary position.
