ABSTRAK
Kurator PT Sky Camping Indonesia PT SCI mengubah status aset boedel pailit SHGB 7251 menjadi aset non boedel untuk kemudian dijual di bawah tangan, yang mana hal tersebut telah mendapatkan persetujuan dari Hakim Pengawas. Hasil dari penjualan aset tersebut kemudian tidak dimasukkan ke dalam daftar pembagian oleh kurator. Kreditor PT SCI, yaitu buruh, menuntut pembayaran upah mereka oleh kurator. Adanya dualisme dalam serikat pekerja PT SCI menjadi alasan kurator untuk tidak melakukan pembayaran atas upah buruh yang terutang. Penelitian ini akan membahas mengenai bagaimana tanggung jawab kurator dan hakim pengawas dalam pengurusan harta pailit PT SCI dan bagaimana perlindungan hukum terhadap kreditor PT SCI. Penelitian ini menggunakan metode penelitian yuridis normatif, yaitu metode penelitian hukum yang meneliti bahan pustaka atau bahan sekunder, dan menganalisis dengan metode kualitatif, sehingga diketahui bahwa kurator dan Hakim Pengawas merupakan pihak dalam kepailitan yang mana tugas satu sama lain saling bertautan dan saling bertanggung jawab atas segala tindakan yang dilakukan dalam menyelesaikan suatu perkara kepailitan. Buruh eks PT SCI berhak mendapatkan pembayaran atas upah yang terutang karena upah buruh merupakan kreditor preferen menurut ketentuan Pasal 95 ayat 4 Undang-Undang Ketenagakerjaan. Dalam melakukan tugasnya, sebaiknya kurator dan Hakim Pengawas memahami kedudukan dan tugas masing-masing sesuai dengan ketentuan dalam Undang-Undang Kepailitan. Upah buruh merupakan tagihan yang harus didahulukan pembayarannya daripada tagihan lainnya, sedangkan legalitas dari serikat pekerja merupakan hal penting yang harus diperhatikan, serikat pekerja seharusnya menjadi representatif bagi buruh eks PT SCI. ABSTRACT
The curator of PT Sky Camping Indonesia PT SCI changed the status of bankruptcy asset SHGB 7251 become a non bankruptcy asset for that asset to be sell underhand, which has got approval from the Supervisory Judge. The proceeds of the selling afterwards is not incuded inside the division list by the curator. The creditor of PT SCI, in this case is the labor, demand the curator regarding the payment of their salary. The dualism inside the labor union of PT SCI becoming the excuse of the curator to not doing the disbursement of the debted salary. This research will answer about how is the responsibility of curator and supervisory judge while arranging and setlling down the bankruptcy asset of PT SCI, and how is the legal protection towards the creditor of PT SCI. This research will be analyzed by using normative juridical method, a research method that will investigate literature and secondary data, and analyzed it with qualitative method, so that will be obtained that Curator and Supervisory Judge are parties in bankruptcy which has linked duties one and another and be liable reciprocally upon every actions that has been done to completing a bankruptcy case. The ex labor of PT SCI reserve the right to acquire the payment of their debted salary, because labor rsquo s salary is preferential creditor according to Article 95 paragraph 4 Act of Employment. While completing their jobs, Curator and Supervisory Judge should understand each other rsquo s position and duty in accordance with the regulations in the Act of Bankruptcy. Labor rsquo s salary is a claim that has to be paid in advance, compared to other rsquo s claim, whilst the legality of labor union should become an important thing that should be noticed, the labor union must be representative towards ex labor of PT SCI.Keywords Curator rsquo s Responsibility, Legal Protection, PT Sky Camping Indonesia
