Skripsi ini menganalisis apakah peraturan perundang-undangan di Indonesia telah memberikan perlindungan terhadap kepentingan Usaha Mikro, Kecil, dan Menengah UMKM dan/ atau industri dalam negeri dalam perdagangan elektronik lintas batas cross-border e-commerce atau tidak dengan membandingkan peraturan perundang-undangan serupa di Republik Rakyat Cina, serta mencari tahu bagaimana seharusnya peraturan perundangan-undangan melindungi UMKM dan/atau industri dalam negeri dan kepentingannya dalam cross-border e-commerce. Dengan melakukan penelitian yuridis-normatif, dapat disimpulkan bahwa peraturan perundang-undangan di Indonesia belum dapat memberikan perlindungan terhadap UMKM dan/ atau industri dalam negeri dan kepentingannya dalam cross-border e-commerce apabila dibandingkan dengan Republik Rakyat Cina. Republik Rakyat Cina telah mengeluarkan beberapa peraturan yang dikhususkan pada cross-border e-commerce yang dapat melindungi industri dalam negeri termasuk UMKM, seperti perpajakan dan bea masuk dalam transaksi cross-border e-commerce, pembatasan transaksi, dan pembatasan komoditas yang dapat diimpor melalui cross-border e-commerce, sedangkan Indonesia belum cukup dalam mengatur hal tersebut. Peraturan yang diberlakukan oleh Republik Rakyat Cina penting untuk diterapkan terutama untuk melindugi produk UMKM dan/ atau industri dalam negeri dari produk impor dari cross-border e-commerce. Oleh karena itu, pemerintah dapat mempertimbangkan untuk merevisi peraturan perundang-undangan yang telah ada atau menerbitkan peraturan perundang-undangan yang dikhususkan untuk melindungi UMKM dan/ atau industri dalam negeri dan kepentingannya dalam cross-border e-commerce.

This undergraduate thesis analyzed whether Indonesias laws and regulations has provide protection towards Micro, Small, and Medium Enterprises MSMEs and or domestic industry interests in cross border e-commerce or not by comparing such laws and regulations in Peoples Republic of China, and how should the laws and regulations provide protection towards MSMEs and or domestic industry in cross border e commerce. By conducting juridical normative research, it concludes that Indonesia has not fully provide protection towards MSMEs and or domestic industry interest in cross border e commerce if compared to Peoples Republic of China. Peoples Republic of China has enacted several regulations that are specialized for cross border e commerce which provide protection towards domestic industry including MSMEs, such as cross border e commerce taxation and duties, transaction limit, and limitation of commodities on cross border e commerce import while, Indonesia has not fully provide to enact such laws and regulations. The laws and regulations that Peoples Republic of China enacted are important to be implemented, especially to protect MSMEs and or domestic industry products from the imported products via cross border e-commerce. Therefore, the government should consider revising the prevailing laws and regulations or promulgate laws and regulations that are specialized to protect MSMEs and its interests in cross border e-commerce.
