Pengenaan denda merupakan salah satu cara untuk menegakkan hukum persaingan usaha. Tujuan dari denda adalah untuk menjerakan pelaku usaha agar tidak melakukan tindakan serupa atau ditiru oleh calon pelanggar lainnya. Indonesia sedang melakukan amandemen terhadap Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat yang salah satu poin yang menjadi fokus amandemen adalah mengenai ketentuan denda. Perubahan ketentuan denda dalam RUU tentang Larangan Praktik Monopoli menimbulkan banyak pro dan kontra. Penelitian ini merupakan penelitian hukum normatif yang menggunakan analisa kualitatif mengenai pengaturan pengenaan denda di Kanada, Inggris, dan Korea Selatan. Pengaturan pengenaan denda pada ketiga negara tersebut dijadikan sebagai bahan rujukan terhadap pengaturan ketentuan denda di Indonesia dan sekiranya dapat menjadi masukan untuk perubahan ketentuan denda di Indonesia. Analisis dari skripsi ini mencapai kesimpulan bahwa perubahan ketentuan denda dalam RUU tentang Larangan Praktik Monopoli masih belum cukup memadai apabila dibandingkan dengan pengaturan ketentuan denda dalam ketiga negara pembanding. Dengan demikian, Pemerintah dan Komisi Pengawas Persaingan Usaha perlu mengkaji kembali perubahan ketentuan denda dalam RUU tentang Larangan Praktik Monopoli agar dapat memberi efek jera, serta disaat yang sama tetap menjamin terlangsungnya iklim persaingan usaha yang sehat oleh para pelaku usaha.

The imposition of fines is one of the method in enforcing Competition Law. The purpose of the fine is to deter business actors to not take similar conducts or to be followed by another potential violator. Indonesia is currently amending Law Number 5 Year 1999 on The Prohibition of Monopolistic Practices and Unfair Business Competition, in which one of the point that serves as the focus of the amendment is regarding provision of fines. The changes within the provisions of fines under the Bill concerning The Prohibition of Monopolistic Practices and Unfair Business Competition raise several pros and cons. This research is a normative legal research by using qualitative analysis concerning the regulation of imposition of fines in Canada, United Kingdom, and South Korea. The regulations on the imposition of fines in these three countries serve as materials for references towards the regulation on the imposition of fines in Indonesia and hopefully may also serve as recommendations to the amendment of the provision of fines in Indonesia. The analysis of this thesis resulted in the conclusion that the Bill of the fine provisions on the Prohibition of Monopolistic Practices is still inadequate in comparison to the fines regulations in the three compared countries. Thus, the Government and the Business Competition Supervisory Commission KPPU need to review the Bill of the fine provisions on Prohibition of Monopolistic Practices in order to give a deterrent effect and at the same time ensuring a healthy business competition by business entrepreneurs.
