ABSTRACT
Indonesia merupakan sebuah negara hukum sebagaimana sudah tertuang dalam UUD 1945. Sebagai negara hukum, hak berpendapat di muka umum juga sudah dijamin dalam pasal 28 Undang Undang Dasar Negara Republik Indonesia Tahun 1945, dimana negara juga bertanggung jawab atas kecerdasan warga negaranya. Namun selama masa Orde Baru dan pasca Reformasi tindakan pembatasan akses informasi dan hak berekespresi di ruang publik masih dilakukan oleh negara. Baik pada masa Orde Baru maupun masa pasca Reformasi Indonesia masih belum berhasil mengaktualisasikan diri sebagai sebuah negara hukum. ABSTRACT
Indonesia is a legal state as already stipulated in the 1945 Constitution. As a legal state, the right to freedom of opinion and expression has also been guaranteed in article 28 of the 1945 Constitution of the State of the Republic of Indonesia, where the state is also responsible for the intelligence of its citizens. However, during the New Order and Post Reform period, the restrictions on access to information and the right to freedom of opinion and expression in the public sphere were still carried out by the state. Both during the New Order and Post Reform era Indonesia still has not succeeded in actualizing itself as a state law.
