ABSTRAK
Yayasan yang berdiri sebelum Undang-undang Yayasan, harus menyesuaikan anggaran dasarnya, apabila tidak Yayasan tidak boleh menggunakan kata ldquo;Yayasan rdquo; didepan namanya dan/atau Yayasan tersebut dapat dibubarkan.Yayasan RJ didirikan pada tahun 1993. Sejak tahun 2008 sampai tahun 2015 Yayasan RJ tidak berbadan hukum. Baru pada tanggal 30 oktober 2015 Yayasan RJ, kembali didirikan dengan menggunakan aset dari Yayasan tahun 1993, tanpa melakukan proses likuidasi terlebih dahulu. Pokok permasalahan tesis ini adalah bagaimana ketentuan pengalihan aset dari Yayasan yang sudah tidak berbadan hukum menurut Undang-undang Yayasan, bagaimana pendirian Yayasan baru dengan nama maksud dan tujuan yang sama, dan bagaimana akibat hukum dari akta Yayasan RJ yang tidak memenuhi ketentuan yang berlaku. Metode penelitian yang digunakan adalah yuridis normatif, dengan menganalisis data sekunder secara kualitatif. Simpulan tesis ini adalah ketentuan mengenai peralihan aset Yayasan yang tidak berbadan hukum tidak diatur secara rinci. Pendirian Yayasan yang sudah tidak berbadan hukum dengan nama, maksud dan tujuan yang sama, mengikuti ketentuan yang diatur dalam Undang-undang Yayasan. Akibat hukum dari akta pendirian Yayasan RJ yang dibuat tidak sesuai dengan ketentuan hukum yang berlaku, akta Notaris tersebut batal demi hukum dan Notaris yang membuat akta tersebut dapat dikenai sanksi administratif atau sanksi perdata.

ABSTRACT
Foundations were established before the Law Foundation, have to adjust their statutes, otherwise the foundation should not use the word foundation in front of its name and or the Foundation can be dissolved. RJ Foundation was founded in 1993. Since 2008 to 2015 RJ was an unincorporated foundation. On the 30th of October 2015 the RJ Foundation, was re established by using the assets of the Foundation in 1993, without making the process of liquidation first. The subject matter of this thesis is how the provisions of the transfer of assets from the foundation that has no legal status under the Law Foundation, how the establishment of new foundation with the name of the same aims and objectives, and how the legal consequences of the deed of RJ Foundation that does not meet the applicable provisions. The research method used juridical normative, by analyzing secondary data qualitatively. The conclusions of this thesis are the provision of transitional asset of the unincorporated Foundation is not regulated in detail. The establishment of the foundation that have no legal entities in the name, purpose and the same objectives, follow the provisions regulated in the Law Foundation. The legal consequences of the deed of establishment of the RJ Foundation made not in accordance with the provisions of applicable law, the notary deed was void by the law and notary who made such deed to sanction administrative or civil sanctions.
