Tesis ini membahas mengenai status dan hak waris dari anak yang dilahirkan dari perkawinan pertama yang dilakukan secara sah dan perkawinan kedua yang dilakukan di bawah tangan. Selain itu, tesis ini juga membahas dampak berlakunya putusan Mahkamah Konstitusi terhadap pembuatan Surat Keterangan Waris oleh notaris dalam kasus perdebatan harta warisan antara istri dan anak-anak dari perkawinan pertama dan perkawinan kedua. Penulisan tesis ini menggunakan jenis penelitian studi kasus dengan pendekatan yuridis-normatif. Berdasarkan hasil pembahasan atas rumusan masalah yang ada, diketahui bahwa Status dari anak perkawinan pertama adalah anak sah sedangkan status dari anak perkawinan kedua adalah anak zina karena asas dari Hukum Perkawinan di Indonesia adalah asas monogami dan agama yang dianut mereka yaitu kristen katolik tidak mengenal adanya poligami sehingga perkawinan tersebut dianggap tidak pernah terjadi. Dikarenakan anak dari perkawinan pertama adalah anak sah, mereka berhak mewaris sedangkan anak dari perkawinan kedua tidak berhak mewaris dan hanya dapat mewaris dari pihak ibu dan keluarga ibunya saja. Dampak dari Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 terhadap pembuatan surat keterangan waris oleh notaris adalah munculnya ahli waris baru yaitu anak luar kawin. Notaris dalam hal ini harus hati-hati dan teliti.

This thesis discusses the status and right of inheritance of the child born of the first legitimate marriage and the second marriage done under the hands. In addition, this thesis also discusses the impact of the enactment of the Constitutional Court decision on the making of the Notarial Inheritance Certificate in case of debate on the estate between the wife and children of the first marriage and the second marriage. This thesis writing uses case study research with juridical normative approach. Based on the results of the discussion of the formulation of the existing problems, it is known that the status of the first marriage is a legitimate child while the status of the second marriage is the adultery because the principle of Marriage Law in Indonesia is the principle of monogamy and religion they embrace that is catholic Catholics do not know the existence of polygamy so the marriage is considered to have never happened. Since the child of the first marriage is a legitimate child, they are entitled to inherit while the child of the second marriage is not entitled to inherit and can only be inherited from the mother and the family of his mother only. The impact of Decision of the Constitutional Court Number 46 PUU VIII 2010 on the making of a certificate of inheritance by a notary is the emergence of new heirs of the outsider. Notary in this case must be careful and thorough.
