Akta hibah PPAT dengan subjek fiktif yang dimana pihak pemberi hibah yang sudah meninggal dunia dibuat fiktif oleh penerima hibah tanpa sepengetahuan PPAT. Dalam pembuatan akta hibah, para pihak tidak menghadap PPAT melainkan PPAT memberikan blanko kosong kepada penerima hibah yang menyebabkan penerima hibah membuat subjek fiktif sebagai pemberi hibah dengan membubuhkan cap jempol pada akta hibah tersebut. Dalam kasus ini, penulis akan membahas mengenai tanggung jawab PPAT atas akta tersebut, serta keabsahan dari akta hibah dengan subjek fiktif tersebut. Metode penelitian ini menggunakan bentuk yuridis normatif, yaitu pendekatan dari sudut kaidah-kaidah dan pelaksanaan peraturan yang berlaku di masyarakat dengan pendekatan kasus Putusan Nomor 93/Pid/B/2016/Pn. Gpr. Sedangkan jenis data yang digunakan ialah data sekunder atau bahan pustaka, yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Metode analisis data yang digunakan di dalam penelitian ini yaitu pendekatan kualitatif. Dilihat dari sifatnya, penelitian ini termasuk ke dalam penelitian deskriptif analitis karena memberikan jalan keluar atau saran untuk mengatasi permasalahan serta berusaha mencari jawaban atas permasalahan. Berdasarkan data hasil yang diperoleh, bahwa akta hibah tersebut menjadi tidak otentik dan karena Pasal 1682 KUHPerdata akta hibah wajib dibuat dengan akta otentik, maka akta hibah tersebut menjadi non-existent. Dan PPAT dalam kasus ini, bertanggung jawab secara administratif, secara perdata karena melanggar Pasal 1365 KUHPerdata, namun tidak dapat dikenakan sanksi pidana.

The deed of grant is issued by Land Deed Official with the fictitious subject when the dead grantor is written fictitiously by the grantee unbeknownst to Land Deed Official. In issuing the deed of grant, the parties do not face Land Deed Official, but Land Deed Official gives the grantee a blank form which encourages the grantee to write a fictitious subject as the grantor by putting a thumbprint on the deed of grant. In this case, the researcher discusses responsibility of Land Deed Official to the deed, as well as validity of the deed of grant with fictitious subject. The normative juridical method was used in this research, with an approach from the perspective of principles and implementation of applicable regulation in the society with the approach of a case, verdict No. 93 Pid B 2016 Pn. Gpr. Meanwhile, the used data were secondary data or literature, which consists of primary and secondary legal materials. The data analysis method used in this research was the qualitative approach. Viewed from its characteristics, this research belongs to the descriptive analysis research since it provides a solution or suggestion to solve the problems and attempts to find an answer to the problem. Based on the obtained result, the deed of grant with fictitious subject turns inauthentic and the deed of grant must be issued with an authentic deed as stipulated in Article 1682 of Indonesian Civil Code. Thus, such deed of grant becomes non existent. In this case, Land Deed Official is administratively responsible since there is an infringement on Article 1365 of Indonesian Civil Code in civil terms, but the criminal sanction cannot be imposed.
