Sertipikat tanah seringkali menjadi persengketaan, tidak terkecuali dengan Sertipikat Hak Tanggungan. Terlebih lagi Hak Tanggungan berkaitan erat dengan hutang piutang. Salah satu permasalahan yang seringkali timbul pada saat proses roya adalah hilangnya Sertipikat Hak Tanggungan. Pada prakteknya, sebagian Kantor Pertanahan mewajibkan adanya Akta Konsen Roya sebagai pengganti Sertipikat Hak Tanggungan yang hilang. Mengenai bentuk dan penggunaan Akta Konsen Roya itu sendiri belum diatur secara jelas dan spesifik dalam peraturan perundang-undangan terkait Hak Tanggungan, sehingga perlu dikaji siapa yang berwenang untuk membuat Akta Konsen Roya dan penggunaannya dalam praktek Roya di Kantor Pertanahan. Pokok masalah dalam penelitian: 1 Standar Operasional Prosedur Roya dalam hal Sertipikat Hak Tanggungan hilang, 2 pertimbangan penggunaan Akta Konsen Roya oleh Kantor Pertanahan dalam hal hilangnya Sertipikat Hak Tanggungan dan 3 Penerapan prinsip kehati-hatian oleh Notaris dalam pembuatan Akta Konsen Roya. Penelitian ini adalah penelitian kualitatif dengan metode yuridis-normatif dan menggunakan tipologi penelitian deskriptif analitis. Berdasarkan hasil penelitian dapat disimpulkan bahwa secara umum perbedaan Standar Operasional Prosedur Roya dalam hal Sertipikat Hak Tanggungan hilang adalah penggunaan Akta Konsen Roya sebagai pengganti Sertipikat Hak Tanggungan yang hilang. Dasar penggunaan Akta Konsen Roya adalah pelaksanaan PERKABAN 1/2010 sebagai wujud prinsip kehati-hatian oleh Kantor Pertanahan, namun tidak semua Kantor Pertanahan mewajibkan penggunaan Akta Konsen Roya. Notaris dalam praktek pembuatan Akta Konsen Roya harus menentukan penghadap Akta Konsen Roya dengan benar dan memeriksa kebenaran formil dokumen dasar pembuatan Akta Konsen Roya.

One of the problems that often arise during the process of Roya is the loss of Certificate of Mortgages . In practice, some Land Office requires a Deed of Consent Roya in lieu of the Lost of Certificate of Mortgage. Regarding the form and use of the Deed of Consent Roya itself has not been clearly regulated and specific in the legislation concerning Mortgage Rights, so it is necessary to review who is authorized to make the Deed of Consent Roya and how it is used in the Roya practice at the Land Office. The subject matter of the research 1 Standard Operational Procedure of Roya in case of the loss of Certificate of Mortgages is to be implemented, 2 Consideration of the use of the deed of consent Roya by the Land Office in case of the loss of Certificate of Mortgages is to be calculated and 3 Precautionary principle apply by Notary in making the Deed of Consent Roya. This research is qualitative research with juridical normative method and using analytical descriptive typology. Based on the result of the research, it can be concluded that in general the difference of Standard Operational Procedure of Roya in case of the loss of Certificate of Mortgages is on the use of the deed of consent Roya as a substitute for the certificate. The use of the Deed of Consent Roya is based on the implementation of the BPN head regulation PERKABAN No. 1 2010 as a form of precautionary principle by the Land Office, but not all the Land Offices require the use of the deed of consent Roya. Notary, in making the deed of consent Roya, must assign the appearer of the deed properly and check the truth of formal document of making Deed of Consent Roya.
