ABSTRAK
Pembuatan Akta Autentik harus memenuhi persyaratan yang ditentukan dalam undang-undang, namun pemahaman mengenai degradasi akta autentik ini pun masih belum luas dipahami baik oleh praktisi hukum maupun masyarakat luas, sehingga timbul perbedaan atau berbagai macam pandangan mengenai degradasi akta berdasarkan pandangan praktisi hukum yang tergambar dalam beberapa putusan yang akan dikaji dalam penelitian ini. Metode penelitian yang digunakan dalam penulisan tesis ini adalah dengan bentuk penelitian yuridis-normatif, serta menggunakan pendekatan kualitatif yang menghasilkan data deskriptif analitis. Suatu akta autentik mengalami degradasi kekuatan pembuktian tidak serta merta terjadi secara otomatis, namun perlu melalui proses peradilan sebagaimana yang ternyata dalam Penjelasan Bagian Umum UU Nomor 30 Tahun 2004 tentang Jabatan Notaris. Akibat hukum yang timbul karena akta autentik yang terdegradasi akta tersebut dapat dibagi menjadi dua bagian yaitu terkait dengan akta yang dibuat berdasarkan kehendak para pihak dan akta yang dibentuk karena adanya perintah dari Undang-Undang. Berdasarkan hasil analisis terhadap beberapa putusan maka terlihat bahwa pegetahuan Hakim mengenai pembuatan akta sangat beragam sehingga menghasilkan putusan yang beragam dan berdasarkan analisis tersebut dapat pula disimpulkan bahwa proses terjadinya degradasi akta ialah melalui proses peradilan. ABSTRACT
The making of an Authentic Deed must fulfilled all the requirements specified in the law, but the understanding of the degradation of this authentic deed is still not widely and clearly understood by both legal practitioners and the community, resulting jurispurudence that has many different views or views on degradation of deed based on the views of the legal practitioner illustrated in several decisions to be reviewed in this study. The research method that I used in writing this thesis is with the form of juridical normative research, and using a qualitative approach that produces analytical descriptive data. An authentic deed experiencing degradation of evidentiary power does not necessarily happen automatically, but it is necessary through the judicial process as it appears in the Elucidation of General Section of Law Number 30 Year 2004 regarding Notary Position. The legal consequences arising from the authentic deeds degraded by the deed may be divided into two parts those relating to a deed made on the basis of the will of the parties and the deed established by the order of the Act. Based on the results of the analysis of some decisions it is seen that the judge 39 s knowledge about the making of deed is very diverse resulting in various decisions and based on the analysis can also be concluded that the process of degradation of deed is through the judicial process.
