ABSTRAK
Tesis ini membahas mengenai perjanjian pengikatan jual beli yang belum lunas dan hendak dialihkan ke pihak lain. Berdasarkan putusan Majelis Pengawas Pusat Notaris Nomor 13/B/MPPN/XII/2017 adalah pelanggaran terhadap Akta Perjanjian Pengikatan Jual Beli yang belum lunas dan dijadikan sebagai dasar dilakukannya peralihan hak atas tanah. Pada kasus tersebut terdapat beberapa permasalahan yang timbul yaitu terkait dengan kekuatan Akta Perjanjian Pengikatan Jual Beli, proses pengalihan hak atas tanah yang hanya didasarkan pada Akta Perjanjian Pengikatan Jual Beli tersebut, dan tanggung jawab Notaris yang bersangkutan. Metode Penelitian yang dipakai untuk menjawab permasalahan tersebut adalah metode penelitian yuridis-normatif dengan pendekatan kualitatif dan bersifat deskriptif analisis. Hasil penelitian yang didapat adalah terhadap kekuatan Akta Perjanjian Pengikatan Jual Beli yang demikian adalah kekuatan pembuktian dibawah tangan yang mana tidak menuangkan keinginan para pihak ke dalam Akta. Proses pengalihan hak dalam kasus ini tidak mengikuti ketentuan perundang-undangan yang mana diharuskan adanya pelunasan objek perjanjian dan pajak-pajak serta biaya lain yang akan timbul juga diikuti dengan dibuatkannya Akta Jual Beli oleh PPAT disertai penyerahan Sertipikat yang telah dibalik nama sehingga tanggung jawab Notaris tersebut adalah sanksi pemberhentian selama 3 tiga bulan dari jabatannya sebagai Notaris. Seorang Notaris harus berhati-hati dan saksama ketika menjalankan jabatannya dengan cara mengecek kembali bukti-bukti surat dan kelengkapan dokumen termasuk pengakuan-pengakuan dari para penghadap dan harus memahami peraturan perundang-undangan sehingga dapat memberikan solusi atau penyuluhan hukum terhadap permasalahan yang terjadi antara para pihak.

ABSTRACT
This thesis discusses about preliminary sales and purchases which has not been fully paid and want to diverted to the other party. Based on The Verdict Of The Notary Council Supervisory Center Number 13 B MPPN XII 2017 which constitutes an offense in which the deed of preliminary sales and purchases that has not been fully paid as the basis for the transfer of land rights. In such cases there are several problems that arise in relation to the strength of the deed of preliminary sales and purchases, the process of transferring rights to land based solely on the deed of preliminary sales and purchases, and the responsibility of the Notary concerned. The research method used to answer the problem is juridical normative research with qualitative approach and descriptive analysis. The conclusion is the strength of the deed of preliminary sales and purchases thus is the strength of evidence under the hand which does not pour the wishes of the parties into the deed. The process of transfer of rights in this case does not comply with the provisions of legislation, which is required for the repayment of the object of the agreement and the taxes and other costs which will arise also followed by the deed of sale and purchase by PPAT accompanied by giving of the certificate which has been reversed, so the responsibility of the Notary as stipulated in MPPN Decision shall be termination sanction for 3 three months from its position as Notary. A Notary must have careful and thoroughly while did their job by doing recheck the completeness of documents, recognition of the parties and also understand the regulations so as to provide solutions or legal counseling to the parties.
