Tesis ini membahas peran dan tanggungjawab Notaris dalam mengeluarkan Cover Note sebagai jaminan dalam Akta Perjanjian Kredit. Permasalahan yang ditemukan yakni dalam penerbitan Cover Note tersebut terdapat unsur yang memuat keterangan yang tidak benar terhadap isi Cover Note tersebut, seperti Notaris memberikan keterangan bahwa Sertifikat Hak milik sudah dilakukan pengecekan ke Badan pertanahan padahal belum dilakukan pengecekan, sehingga pada saat diikat jaminannnya terdapat permasalahan yang timbul terhadap jaminan sertipikat tersebut. Metode Penelitian yang digunakan dalam tesis ini adalah yuridis normatif, bersifat deskriptif analisis dengan pendekatan kualitatif. Hasil penelitian ini menunjukan bahwa prosedur dalam mengeluarkan Cover Note sebagai jaminan dalam Akta Perjanjian Kredit adalah ketika proses pengikatan agunan di Kantor Pertahanan belum selesai, maka sebagai antisipasi dikeluarkan Cover Note yang merupakan Surat Keterangan dari Notaris yang berisikan pernyataan/janji sanggup melaksanakan pekerjaan dengan kepastian jangka waktu tertentu. Karena lahirnya Cover Note mempengaruhi komitmen Notaris, maka Notaris dapat dimintakan pertanggungjawaban jika dalam penerbitan Cover Note tersebut terdapat unsur yang memuat keterangan yang tidak benar. Akibat hukum dari Cover Note palsu yang dikeluarkan oleh Notaris adalah apabila Cover Note tersebut ternyata palsu maka Cover Note tersebut menjadi tidak berlaku, akan tetapi tidak mempengaruhi keabsahan dari Akta Perjanjian Kreditnya. Cover Note dan Akta Perjanjian Kredit bukan merupakan satu kesatuan, sedangkan yang mempengaruhi keabsahan Akta Perjanjian Kredit adalah terpenuhinya syarat-syarat Akta Autentik dalam Undang-Undang Jabatan Notaris.

This thesis discusses the role and responsibility of a Notary Public in issuing Cover Note as security of Deed of Credit Agreement. The issue identified in the issuance of Cover Note is the false information in the Cover Note, for example Notary Public attesting that the Certificate of Ownership has been verified with the Land Agency but in fact, no such verification has been made, which would cause issue in the security agreement as to the certificate. The Research Method used in this thesis is juridical normative, descriptive analysis with a qualitative approach. This research shows that the procedure in the issuance of Cover Note as a security in the Deed of Credit Agreement is the entry into of collateral agreement at the Land Agency is not completed, then in anticipation of the issuance of the Cover Note, which an attestation by the Notary Public of the undertaking to perform the work within a specified term. Since Cover Note would affect the commitment of the Notary Public, he she may be held liable if the issuance of Cover Note contain incorrect information. The legal consequence of false Cover Note issued by the Notary Public is, when same is found falsified, Cover Note will be rendered void, however it will not impair the validity of the Deed of Credit Agreement. Cover Note and the Deed of Credit Agreement do not form integral part, and those affecting the validity of the Deed of Credit Agreement is the fulfillment of the terms set out in the Authentic Deed in the Notary Public Law.
