ABSTRAK
UNCAC Tahun 2003 menawarkan non-conviction based asset forfeiture untuk diberlakukan di setiap negara sebagai alternatif perampasan terhadap hasil tindak pidana. Perampasan aset tanpa penghukuman terhadap pelaku memberikan terobosan terhadap kelemahan pengaturan KUHP yang masil berorientasi terhadap pelaku. Model perampasan ini berlaku untuk setiap hasil kejahatan meskipun telah bercampur dengan dana yang sah dan dikuasai oleh pihak lain. Saham menjadi kualifikasi aset tersebut. Kepastian hukum terhadap saham tersebut perlu untuk dianalisa jika atasnya diterapkan non-conviction based asset forfeiture. Ketidakmampuan pelaku untuk hadir dan membuktikan bahwa aset yang dimilikinya merupakan hasil perolahan dana yang sah. Namun, kendala terhadap saham sendiri tidak dapat disamakan dengan perampasan harta lainnya. Kepemilikan saham serta penguasaan oleh pihak ketiga menjadi salah satu kendala untuk dapat menelusuri saham sebagai aset tercemar. Tujuan dari penelitian ini yaitu untuk menghadirkan undang-undang yang lebih komprehensif dibandingkan pengaturan yang ada saat ini. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, konsep dan kasus. Non-conviction based asset di Indonesia masih diatur berdasarkan gugatan perdata dan Perma No. 1 Tahun 2013. Tahapan-tahapan perampasan aset berdasarkan 2 peraturan tersebut masih memiliki kendala yang dapat merugikan negara dalam hal perampasan saham. Sistem hukum di Indonesia masih belum memberikan perlindungan dan kepastian hukum terhadap perampasan aset khususnya terhadap saham.

forfeiture as an alternative to seizure proceed of crime. Non conviction based asset forfeiture provide a breakthrough against susceptibility Criminal Code that its in personam oriented. This forfeiture model is applied to each proceed crime eventhough derivied from or obtained directly or indirectly, through commison of an offence. Thus, its applying to asset as stock of corporate. The certainty of law of stock as an asset of corporate must has analized when non conviction based asset forfeiture applied. The ability of offender to present and prove the asset is not derived from aset legally tainted. Nevertheless, the obstacles to seizure the stock of corporate is distinguish than others proceed of crime. The ownership of beneficial owner and corporate control of stock is one of the obstacles to track the proceed of crime. The aim of this paper is to encourage goverment to apply statute of asset recovery. The method is juridicial normative with statute, cases and concept approach. Non conviction based asset forfeiture according to civil procedure and Perma No. 1 Tahun 2013. Stages of asset forfeiture according its rules has any weaknesses to seizure the stock of corporate as a proceed of crime. Indonesia systems of law has not been able to give a protection and certainty of law to forfeit the stock.
