ABSTRAK
Perbatasan perairan suatu negara seringkali menimbulkan suatu konflik apabilawilayah suatu negara tidak memiliki kejelasan yang pasti, hal tersebut dikarenakandalam hukum internasional wilayah negara mempunyai peran yang sangat pentingdalam melaksanakan yurisidiksi suatu negara. Seperti halnya delimitasi maritim zonaekonomi eksklusif Indonesia dengan Vietnam di Laut Natuna Utara, yang sedangberkembang saat ini adalah belum adanya kesepakatan (undelimited area) batas zonaekonomi eksklusif di laut Natuna Utara Indonesia dengan Vietnam. Sehinggamengakibatkan saling klaim terhadap pemanfaatan sumber daya alam hayatiperikanan di zona ekonomi eksklusif tersebut begitu pula dengan penegakanhukumnya (law enforcement), seperti halnya kejadian saling tangkap antara aparatpenegak hukum di laut baik oleh Indonesia maupun aparat penegak hukum di lautVietnam ataupun terhadap nelayan Vietnam yang melakukan penangkapan ikan dizona ekonomi eksklusif laut Natuna Utara tersebut. UNCLOS 1982 menawarkanbeberapa mekanisme penyelesaian sengketa sambil menunggu kesepakatan perjanjiandelimitasi maritim tersebut, salah satunya dengan kerjasama antar negara pantaiberdasarkan pembentukan perjanjian delimitasi ZEE yang saling tumpang tindih,serta adanya penyelesaian secara diplomatik oleh pihak ketiga dan penyelesaiansecara hukum melalui ITLOS maupun ICJ/Mahkamah International.

The borders of a country's waters often cause a conflict if the territory of a countrydoes not have definite clarity, this is because in international law the territory of thecountry has a very important role in carrying out the jurisdiction of a country. Aswith the maritime delimitation of Indonesia's exclusive economic zone with Vietnamin the North Natuna Sea, which is currently developing, there is an undelimited areaof exclusive economic zone boundaries in the North Natuna Sea of Indonesia andVietnam. Thus resulting in mutual claims against the utilization of the living naturalresources of fisheries in the exclusive economic zone as well as law enforcement (lawenforcement), as well as the occurrence of mutual arrest between law enforcementofficers in the sea both by Indonesia and law enforcement officers in the Vietnamesesea or fishermen Vietnam is fishing in the exclusive economic zone of North NatunaUNCLOS 1982 offers several dispute resolution mechanisms while awaiting theagreement of the maritime delimitation agreement, one of which is cooperationbetween coastal countries based on the formation of overlapping exclusive economiczone delimitation agreements, and diplomatic settlement by third parties and legalsettlement through ITLOS and International Court of Justice.
