Notaris berwenang untuk membuat akta pendirian Perseron Terbatas, yayasan, koperasi CV, persekutuan perdata, dan firma. Sehingga pendirian CV dilakukan dengan akta Notaris. Ketatnya persaingan antar notaris disertai banyaknya jumlah pesaing terkadang membuat notaris baru hanya bisa mendapatkan sedikit klien, hal ini mengakibatkan rendahnya tingkat penghasilan notaris sehingga mengalami kesulitan untuk membayar pegawai notaris untuk dijadikan saksi akta sehingga menjadikan istri sebagai saksi. Tujuan dari penulisan tesis ini adalah untuk menganalisis sanksi degradasi dan kebatalan suatu akta notaris yang dibuat tidak sesuai dengan Undang-Undang No. 2 tahun 2014 tentang perubahan atas Undang-Undang No. 30 tahun 2004 tentang Jabatan Notaris (UUJN) dan keabsahan akta pendirian CV yang dibuat dengan akta otentik di mana saksi akta adalah Istri Notaris. Metode penelitian yang digunakan adalah yuridis normatif, menggunakan data sekunder dan menganalisa secara kualitatif.Berdasarkan hasil penelitian, akta Notaris terdegradasi kekuatan pembuktiannya menjadi akta di bawah tangan karena terdapat pelanggaran mengenai kewajiban notaris, pembacaan akta, pengecualian pembacaan, ketentuan kriteria penghadap, saksi akta, serta larangan pembuatan akta untuk diri sendiri, istri/suami dan orang yang mempunyai hubungan keluarga. Sementara akta Notaris yang mengalami pembatalan atau batal demi hukum adalah akta Notaris yang melanggar ketentuan Pasal 84 UUJN. Akta Pendirian CV yang dibuat dengan Saksi Akta adalah istri notaris berdasarkan Pasal 41 UUJN aktanya telah menjadi akta di bawah tangan. Terdegradasinya akta pendirian CV menjadi dibawah tangan tidak membuat CV menjadi bubar atau berakhir selama hal tersebut tidak merugikan pihak ketiga.

Notary is authorized to make a Deed of Establishment of a Limited Liability Company, Foundation, Cooperative, Limited Partnership, Limited Liability Partnership and firm.  In this sense, the establishment of a Limited Partnership is carried out by notarial deed. The fierce competition between notaries and the large number of competitors makes a new notary only able to get a handful of clients. This results in the low level of income for the notary which lead to the difficulty in hiring as well as paying notary employee to become a witness deed and instead, putting the wife in a witness role due to insufficient fund. The purpose of this journal is to analyze the degradation sanctions and cancellation of a notary deed made in accordance with UUJN (Act Number 2 of 2014 towards amandement Act Number 30 of 2004 concerning Notary Position) and the validity of the Limited Partnership`s establishment deed made with an authentic deed in which the deed`s witness is the notary`s wife. The research method used in writing this journal is normative juridical using secondary data and analyze qualitatively.Based on the results of the study, the boundary of the notarial deed which was degraded by the power of proof into a Privately Made Deed is a notarial deed that violates the notary obligation, the reading of the deed, the exception of the reading, the adherence criteria, the witnesses of the deed, and the prohibition of making the act for themselves, the wife/husband and the person having a family relationship. Meanwhile, the Notary deed that has been cancelled or null and void by law is a notary deed that violates the provisions of Article 84 of UUJN. Based on Article 41 UUJN, The Limited Partnership`s Establishment Deed made on the basis that the notary`s wife acted as the Witness Deed, will become a Private Deed. The degradasion of the establishment deed into a sub deed doesn`t make the limited partnership dissolve or end as long as it doesn`t harm the third party.
