Notaris adalah Pejabat umum untuk membuat akta autentik. Salah satu akta autentik yang dibuat adalah akta Perjanjian Pengikatan Jual Beli. Jika dalam membuat Perjanjian Pengikatan Jual Beli Notaris tidak teliti dan cermat, akibatnya terdapat cacat hukum didalam akta tersebut. Dan Majelis pengawas berhak memutuskan sanksi kepada noTesis ini membahas mengenai ketidaksesuaian antara rekomendasi Majelis Pengawas Daerah dengan putusan Majelis Pengawas Wilayah terhadap studi putusan Majelis Pengawas Pusat.Permasalahan yang yang dibahas dalam tesis ini adalah keabsahan Perjanjian Pengikatan Jual Beli yang dibuat oleh Notaris yang cacat hukum dan bagaimana akibat hukum terhadap putusan Majelis Pengawas Pusat yang mendasarkan atas putusan Majelis Pengawas Wilayah yang tidak sesuai dengan Majelis Pengawas Daerah.Metode Penelitian yang digunakan dalam tesis ini adalah yuridis normatif dengan tipe penelitian yang bersifat deskriptif analitis. Jenis data yang digunakan dalam penelitian ini adalah data sekunder dengan pendekatan kualitatif.Penelitian yang diperoleh dalam tesis ini adalah Notaris melakukan perbuatan melawan hukum sehingga akta Perjanjian Pengikatan Jual Beli yang dibuat menjadi dibawah tangan, dan Majelis Pengawas telah memutuskan dengan keseimbangan dan adil.

Notaries are general officials appointed by the State to make authentic deeds. One of the authentic deeds made is the deed of the Sale and Purchase Agreement. If in making a deed the Notary Sale and Purchase Agreement is not thorough and accurate, as a result there is a legal defect in the deed. And the supervisory board has the right to decide sanctions on the notary.

This thesis discusses the discrepancy between the recommendations of the Regional Supervisory Board and the decision of the Regional Supervisory Board on the study of the decisions of the Central Supervisory Board.

The problem discussed in this thesis is the validity of the Sale and Purchase Agreement made by a notary who is legally handicapped and how the legal consequences of the decision of the Central Supervisory Board based on the decision of the Regional Supervisory Board are not in accordance with the Regional Supervisory Board.

The research method used in this thesis is normative jurid with the type of descriptive analytical research. The type of data used in this study is secondary data with a qualitative approach.

The research obtained in this thesis is that the Notary commits an unlawful act so that the deed of the Sale and Purchase Agreement that is made becomes underhanded, and the Supervisory Board has decided with balance and fairness.
