Tesis ini membahas kewenangan dalam hal impor produk hortikultura terutama bawang putih antara Departemen Pertanian dan Departemen Perdagangan. Namun, kewenangan ini menjadi tumpang tindih karena penghapusan Pasal 6 dalam Peraturan Menteri Pertanian No. 38 tahun 2017 yang menyebabkan impor produk hortikultura dapat dilakukan tanpa pertimbangan panen periode dan penghapusan Pasal 12 ayat (1) dalam Peraturan Menteri Keuangan Menteri Perdagangan No. 30 tahun 2017 yang menyebabkan dihapusnya Importir Umum. Tesis ini adalah penelitian hukum normatif yang berfokus pada hukum positif yang mengatur otoritas Departemen Pertanian dan Departemen Perdagangan dalam masalah mengimpor bawang putih dan wawancara untuk mengkonfirmasi data. Masalah utama tesis ini adalah wewenang Kementerian Pertanian dan Kementerian Perdagangan dalam mengatur impor bawang putih, dampak dari penghapusan Jenderal Importir dan pemenuhan kebutuhan bawang putih karena Importir Umum dihapus. Hasil dari penelitian ini adalah penghapusan Pasal 6 Peraturan Menteri Pertanian No. 38 tahun 2017 dan penghapusan Pasal 12 ayat (1) dalam Peraturan Menteri Perdagangan Nomor 30 Tahun 2017 menyebabkan tumpang tindih wewenang antara Departemen Pertanian dan Kementerian Perdagangan. Apalagi dampak penghapusan Pasal 12 ayat (1) Peraturan Menteri Perdagangan No. 30 tahun 2017, Pengimpor Umum tidak dapat menjalankan usaha impor bawang putih. Pemenuhan kebutuhan impor bawang putih produk masih dapat dilakukan oleh perusahaan yang memiliki Importir Produsen dan BUMN. BUMN yang ingin mengimpor bawang putih harus berkewajiban mengembangkan penanaman bawang putih dan ada kebutuhan untuk memantau kewajiban mengembangkan bawang putih sehingga swasembada bawang putih dapat diwujudkan.

This thesis discusses authority in terms of imports of horticultural products especially garlic between the Department of Agriculture and the Department of Commerce. However, this authority is overlapping due to the abolition of Article 6 of Minister of Agriculture Regulation No. 38 of 2017 which causes the import of horticultural products can be carried out without consideration of the harvest period and the elimination of Article 12 paragraph (1) in the Minister of Finance Regulation No. Minister of Trade No. 30 of 2017 which caused the elimination of General Importers. This thesis is a normative legal research that focuses on positive laws governing the authority of the Department of Agriculture and the Department of Commerce on the issue of importing garlic and interviews to confirm data. The main problem of this thesis is the authority of the Ministry of Agriculture and the Ministry of Trade in regulating the import of garlic, the impact of the elimination of the General Importer and the fulfillment of the needs of garlic because the General Importer is removed. The result of this research is the abolition of Article 6 of Minister of Agriculture Regulation No. 38 of 2017 and the abolition of Article 12 paragraph (1) in Regulation of the Minister of Trade No. 30 of 2017 causes overlapping authority between the Ministry of Agriculture and the Ministry of Trade. Moreover, the impact of eliminating Article 12 paragraph (1) Minister of Trade Regulation No. 30 of 2017, General Importers cannot operate a garlic import business. Meeting the needs of imported garlic products can still be done by companies that have Producer Importers and SOEs. BUMN that wants to import garlic must be obliged to develop garlic planting and there is a need to monitor the obligation to develop garlic so that garlic self-sufficiency can be realized.
