Netflix merupakan Perusahaan yang berasal dari amerika serikat yang bergerak di bidang penyewaan film dan serial Televisi dengan sistem subscribe yang didistirbusikan secara digital atau online. Saat ini rezim internasional yang mencakup jasa adalah General Agreement on Trade in Services (GATS), dimana Netflix termasuk lingkup instrumen internasional tersebut. Secara garis besar GATS mengatur jasa-jasa yang telah melintasi batas wilayah Negara dan Schedule of Commitment (SoC) setiap anggota World Trade Organization (WTO) untuk memperlakukan setiap jasa yang masuk ke wilayah masing-masing negara tersebut berdasarkan prinsip-prinsip GATS. Penelitian ini menggunakan kajian hukum normatif dengan sifat penelitian presktiptif dan pendekatan Konseptual. Hasil penelitian ini menunjukan bahwa Jasa Netflix termasuk dalam mode Cross Border Supply (Mode 1) dan diklasifikasi pada sektor Communication sub sektor Audiovisual Services berdasarkan Klasifikasi MTN.GNS/W/120. Dari sisi SoC Indonesia menyatakan bahwa sektor audiovisual service untuk mode 1 ialah Unbound, dimana dibolehkan mengatur  jasa yang termasuk mode 1 dan dapat mengecualikan ketentuan GATS. Kehadiran Surat Edaran Menteri Komunikasi dan Informasi No 3 Tahun 2016 tentang  Penyediaan Layanan Aplikasi Dan/Atau Konten Melalui Internet (Over The Top) telah digunakan untuk mengatur jasa Netflix, salah satu substansi pasalnya mengatur untuk mendirikan badan usaha tetap (BUT) dapat dilaksanakan berdasarkan SoC Indonesia, namun implementatifnya kurang karena tidak mempunyai sanksi. Preskripsi untuk penelitian ini adalah Kementrian Komunikasi dan Informasi dapat membuat Peraturan Menteri dengan substnasi pasal seperti pengenaan pajak tanpa harus mendirikan BUT yang seyogyanya selaras dengan ketentuan GATS.

Netflix is a company originating from the United States that is engaged in television movie and serial rentals with a subscription system that is distributed digitally or online. At present international regulations covering services are the General Agreement on Trade in Services (GATS), where as GATS has regulate the Schedule of Specific Commitment (SoC) of each member of the World Trade Organization (WTO) to handle every service that enters the territory of each country in accordance with GATS principles. This study uses normative legal studies with the nature of prescriptive research and conceptual search. The results of this study indicate that Netflix Services are included in the Cross Border Supply (Mode 1) and classified in the Audiovisual Service sub-sector Communication sector based on the MTN.GNS/W/120 Classification. From the Indonesian SoC`s perspektif declaring audiovisual services for mode 1 is Unbound, where services that in scope mode 1 can exclude GATS provisions. The presence of Circular Letter of the Minister of Communication and Information No. 3 of 2016 concerning the provision of Over the Top Application and/or Content Services has been used to provide Netflix services, one of the substance of the article issued to obtain a permanent establishment (BUT) can be implented, but the implementation is lacking because it does not have sanctions. The prescription for this study is that the Ministry of Communication and Information can make a Ministerial Regulation with article subtitles such as taxation without having to make a BUT which should be in line with GATS provisions.
