ABSTRAK
Pelaksanaan kerja sama pembangunan rumah yang mensyaratkan adanya Akta Jual Beli Lunas tidaklah sesuai dengan aturan pembuatan  Akta Jual Beli, yang seharusnya dibuat berdasarkan asas terang dan tunai, namun hal ini terjadi di kota Denpasar-Bali, melalui putusan nomor 603/Pid.B/2017/PN Dps, dimana terdapat kasus adanya perjanjian kerjasama pembangunan rumah yang mensyaratkan adanya Akta Jual Beli Lunas, namun pada kenyataannya Akta Jual Beli yang telah dibuat oleh Pejabat Pembuat Akta Tanah tersebut belum lunas pembayarannya. Dari kasus tersebut dua permasalahan yaitu, pelaksanaan kerja sama pembangunan rumah yang mensyaratkan adanya akta jual beli lunas berkaitan dengan kekuatan mengikat terhadap para pihak, dan perlindungan hukum bagi Pejabat Pembuat Akta Tanah terhadap pembuatan akta jual beli yang belum lunas. Penelitian ini merupakan penelitian yuridis normatif, dengan menggunakan data sekunder, dan menganalisis data secara kualitatif. Dari hasil analisis dapat ditarik kesimpulan bahwa Pelaksanaan perjanjian kerjasama pembangunan rumah yang mensyaratkan adanya akta jual beli lunas adalah salah satu bentuk adanya penyalahgunaan keadaan. Pelanggaran kesepakatan, melanggar syarat subyektif sahnya perjanjian. Tapi meskipun menyebabkan tidak sahnya suatu perjanjian, namun karena melanggar syarat subyektif maka perjanjian tidak batal demi hukum, tapi dapat dibatalkan, jadi sepanjang tidak dibatalkan maka tetap mengikat para pihak. Sedangkan bagi Pejabat Pembuat Akta Tanah yang membuat Akta Jual Beli tersebut adalah dilindungi oleh kebenaran formil, dimana Pejabat Pembuat Akta Tanah tidak bertanggung jawab terhadap kebenaran materil dari akta yang dibuatnya tersebut.

ABSTRACT
The Implementation of house development cooperation that requiring full payment Sale and Purchase Deed is not in accordance with the rules for the Sale and Purchase Deed, which should be based on the principle of Light and Cash, but this happened in the city of Denpasar-Bali, through decision number 603/Pid.B/2017/PN Dps, where there is a case of a house development cooperation agreement that requires the full payment of sale and Purchase Deed, but in fact the Sale and Purchase Deed that has been made by the Land Deed Making Officer has not been paid in full. From this case there are two problems, first the implementation of cooperation in housing construction which requires the sale and purchase deed is related to the binding force of the parties, and second, legal protection for Land Deed Making Officer to make the sale and purchase deed that has not been settled. This research is a normative juridical research, using secondary data. From the results of the analysis it can be concluded that the implementation of the housing construction cooperation agreement that requires the sale and purchase deed is one form of abuse of circumstances. Violation of the agreement, violating the subjective conditions of the validity of the agreement. But even though it causes an agreement to invalid, but because it violates the subjective conditions, the agreement is not null and void, but can be canceled, so long as it is not canceled, it remains binding on the parties. Whereas the Land Deed Making Officer who makes the Sale and Purchase Deed is protected by formal truth, where the Land Deed Making Officer is not responsible for the material truth of the deed he made.
