ABSTRAK
Tesis ini membahas mengenai tukar menukar hak atas tanah berdasarkan ketentuan Hukum Tanah Nasional dan peraturan-peraturan terkait (Studi Putusan PN Depok No. 211/Pdt.G/2018/Pn.Dpk). Pokok permasalahan dalam penulisan tesis ini adalah mengenai keabsahan tukar menukar hak atas tanah secara umum dan keabsahan tukar menukar hak atas tanah yang dilakukan secara lisan oleh penggugat dan tergugat dalam Putusan PN Depok No. 211/Pdt.G/2018/Pn.Dpk. Penulisan tesis ini menggunakan metode penelitian yuridis normatif dengan tipe penelitian yang bersifat deskriptif analitis. Dari hasil penelitian dapat diketahui bahwa tukar menukar hak atas tanah adalah sah, apabila memenuhi syarat sahnya suatu perjanjian akan tukar menukar menurut Hukum Perjanjian dan memenuhi syarat sahnya suatu perbuatan hukum pemindahan hak menurut Hukum Tanah Nasional. Penulis tidak setuju dengan pertimbangan Majelis Hakim Pengadilan Negeri Depok yang menyatakan bahwa tukar menukar hak atas tanah yang dilakukan pihak Penggugat dan pihak Tergugat adalah sah. Menurut Penulis tukar menukar hak atas tanah yang dilakukan pihak Penggugat dan pihak Tergugat adalah tidak sah, hal ini dikarenakan tukar menukar hak atas tanah tersebut hanya dilakukan secara lisan saja dan karena tukar menukar hak atas tanah tersebut tidak memenuhi sifat tunai, terang dan riil suatu perbuatan hukum pemindahan hak. Sebaiknya tukar menukar hak atas tanah dibuktikan Akta PPAT karena tanpa Akta PPAT para pihak akan mengalami kesulitan dalam pendaftaran peralihan haknya di Kantor Pertanahan dan mengingat sifat tanah sebagai benda tetap yang harus didaftarkan (asas publisitas).

ABSTRACT
This thesis discusses the exchange of land rights based on national Land Law and related regulation (Study of the Decision of The Depok Disctrict Courts No.211/Pdt. G/2018/Pn.Dpk). The subject matter in writing this thesis is about the validity of the exchange of land rights in general and the validity of the exchange of land rights which is done verbally by the plaintiff and defendant in the verdict of PN Depok No.211/Pdt.G/2018/Pn.Dpk. This thesis uses normative juridical research method with a type of research that is descriptive analytic. From the results of the research can be noted that the exchange of land rights is valid, if it qualifies as a treaty will be exchanged according to the law of the Agreement and qualifies as a legal act to transfer rights under the law of the national land. The author disagrees with the consideration of the Tribunal of the District Court of Depok stating that the exchange of land rights made by the plaintiff and the defendant party are valid. According to the author exchange of land rights carried by the plaintiff and the defendants party is not valid, this is because the exchange of land rights is only done orally and because the exchange of land rights does not fulfill the nature of cash, light and real a legal action of the transfer of rights. The exchange of land rights should be carried out with the PPAT Deed because without the PPAT deed the parties will have difficulty in registering its rights in the land office and considering the nature of the land as a fixed object that must be registered (the principle of publicity).
