Tesis ini membahas mengenai pengalihan objek jaminan fidusia yang belum didaftarkan oleh pihak debitur tanpa sepengetahuan pihak kreditur sebagaimana yang ada dalam Putusan Mahkamah Agung Nomor 1271 K/Pdt/2016. Permasalahan pada tesis ini adalah 1) Legalitas pengalihan objek jaminan fidusia yang belum didaftarkan tanpa persetujuan kreditur; 2) Perlindungan hukum bagi kreditur dalam hal debitur mengalihkan objek jaminan fidusia yang belum didaftarkan tanpa persetujuan kreditur. Metode penelitian ini adalah penelitian yuridis normatif, dengan menggunakan data sekunder yang dikumpulkan melalui studi literatur. Menggunakan metode pendekatan kualitatif, yang mana menghasilkan bentuk hasil penelitian yaitu deskriptif analitis. Simpulan dari penulisan tesis ini adalah pengalihan objek jaminan fidusia yang belum didaftarkan tanpa persetujuan kreditur merupakan tindakan yang tidak dibenarkan menurut hukum (tidak sah) dan perlindungan hukum bagi kreditur dalam hal debitur mengalihkan objek Jaminan Fidusia yang belum didaftarkan tanpa persetujuan kreditur dapat dikenakan tanggung jawab perdata dan pidana bagi debitur tersebut. Saran dari penulis adalah perusahaan lembaga pembiayaan wajib menaati ketentuan yang termuat dalam Undang-Undang Jaminan Fidusia terkait pelaksanaan perjanjian Jaminan Fidusia, seperti melakukan pendaftaran perjanjian Jaminan Fidusia melalui pembuatan akta Jaminan Fidusia oleh Notaris dan didaftarkan ke Kementerian Hukum dan Hak Asasi Manusia Republik Indonesia untuk diterbitkan sertifikatnya.

This thesis discusses the transfer of unregistered fiduciary collateral objects by the debtor without the approval of the creditors as contained in the Decision of the Supreme Court Number 1271 K/Pdt/2016. Problems in this thesis are 1) Legality of the transfer of unregistered fiduciary collateral objects without the creditors approval; 2) Legal protection for creditors in the event that the debtor transfers unregistered fiduciary collateral objects without the creditors approval. This research method is a normative juridical study with the nature of descriptive research, using secondary data collected through literature studies. Using a qualitative approach, which produces a form of research results that is descriptive analytical. The conclusion from the writing of this thesis is that the transfer of unregistered fiduciary collateral objects without the creditors approval is an unlawful act. Legal protection for creditors in the event that the debtor transfers the object of the unregistered Fiduciary Guarantee without the creditors approval may be subject to civil and criminal liability for the debtor. The suggestion from the writer is that the financial institution company must obey the provisions contained in Fiduciary Guarantee Law related to the implementation of the Fiduciary Guarantee agreement, such as registering a Fiduciary Guarantee agreement through the making of a Fiduciary Deed by the Notary Public and being registered with the Ministry of Law and Human Rights of the Republic of Indonesia for its certificate.
