Seiring dengan kemajuan teknologi, kini penjualan obat tak lagi hanya melalui apotek atau toko obat yang dilakukan secara fisik atau tatap muka. Kini banyak situs daring seperti, apotek commerce maupun media sosial yang menawarkan dan menjual berbagai produk farmasi. Dengan keadaan demikian, ÃÂ konsumen dapat dengan mudah mendapatkan obat - obatan tersebut termasuk obat keras dan obat tanpa izin edar yangÃÂ dapat membahayakan kesehatan konsumen.ÃÂ Penelitian yuridis-normatif ini akan membahas mengenai upaya pengawasan yang dilakukan BPOM maupun pelaku usaha dalam mengatasi peredaran obat keras dan tanpa izin edar pada situs jual beli daring di Indonesia serta menganalisis apakah regulasi yang ada telah melindungi konsumen. Berdasarkan hasil penelitian, dapat disimpulkan bahwa regulasi yang ada saat ini masih bersifat sektoral dan ÃÂ masih mengatur sebatas peredaran obat secara kovensional sehinggaÃÂ diperlukan adanya peraturan yang mengatur secara spesifik mengenai peredaran obat secara daring sehingga dapat memberikan kepastian dan perlindungan hukum bagi konsumen. Adapun upaya pengawasan yang telah dilakukan masih terkendala oleh keterbatasan anggaran, sarana dan prasarana serta sumber daya manusia.
Along with technological advances, drug sales are now no longer only through pharmacies or drug stores that are carried out physically or face to face. But nowdays, many online sites such as online pharmacies, online marketplace, and social media offer and sell various pharmaceutical products. Under these circumstances, consumers can easily obtain drugs including prescription drugs and unlicensed drugs which can endanger consumerâÂÂs health. Through normative juridical research, this thesis will discusses the supervision efforts by BPOM and business actors to overcome the circulation of prescription drugs and unlicensed drugs on online marketplace in Indonesia and analyzes whether the existing regulations have protected consumers. Based on the results of the study, it can be concluded that the current regulations are still sectoral and only regulate the distribution of drugs conventionally so that there is a need for regulations that specifically regulate drug distribution online so as to provide legal certainty and legal protection for consumers. Meanwhile, the supervision that have been done are still constrained by the limitation of budget, facilities and infrastructure as well as human resources.
