Tesis ini membahas mengenai sengketa tanah waris yang tidak bisa dilakukan proses persertipikatan untuk pertama kalinya oleh sang ahli warisnya. Kasus ini diawali dengan penerbitan Sertipikat Hak Atas Tanah sebidang tanah dengan bukti girik yang dikeluarkan oleh Kepala Kantor Pertanahan Kabupaten Bangkalan, yaitu Sertipikat Hak Milik Nomor 00163 Desa Kel. Petapan. Penerbitan sertipikat tersebut ternyata merugikan pihak ketiga yang hendak melakukan pendaftaran tanah untuk pertama kalinya atas tanah girik yang dia peroleh dari peristiwa pewarisan sehingga secara hukum, dia kehilangan haknya atas tanah waris tersebut. Oleh karena itu, Sertipikat Hak Milik tersebut seharusnya dibatalkan karena secara nyata merugikan pihak ahli waris. Hal ini menimbulkan tanggung jawab hukum yang harus dilakukan oleh Kepala Kantor Pertanahan Kabupaten Bangkalan pasca penetapan dalam Putusan PTUN Surabaya Nomor 169 G 2018 PTUN.SBY Tahun 2019.Metode penelitian dalam tesis ini bersifat yuridis normatif dengan menganalisa sistematika hukum yang meliputi subjek hukum, hak dan kewajiban, perbuatan hukum, hubungan hukum, dan obyek hukum. Tipe penelitian yang digunakan dalam tesis ini adalah penelitian deskriptif analitis, untuk mendeskripsikan, menggambarkan, menelaah, dan menjelaskan secara analitis permasalahan yang dikemukakan. Dalam analisa kasus ini diketahui terdapat cacat administrasi dalam penerbitan Sertipikat Hak Milik Nomor 00163 Desa Kel. Petapan. Kepala Kantor Pertanahan Kabupaten Bangkalan harus melakukan pembatalan Sertipikat Hak Milik tersebut serta melakukan pemeliharaan data pendaftaran. Penulis memberikan saran agar kegiatan pengumuman data fisik dilakukan dengan cara yang lebih efektif dan efisien serta lebih meningkatkan kehati-hatian Kantor Pertanahan dalam melaksanakan tugasnya.

This thesis discusses inheritance land disputes which cannot be held for the first time by the heirs. The case began with the issuance of a Land Rights Certificate with a piece of land with girik evidence issued by the Head of the Bangkalan Regency Land Office, namely Certificate of Land Ownership Number 00163 Desa Kel. Petapan. The issuance of the certificate turned out to be detrimental to a third party who wanted to register land for the first time over the girik land he obtained from the inheritance event so that he legally lost his right to the inheritance. Therefore, the certificate of ownership should be canceled because it is clearly detrimental to the heirs. Therefore, legal responsibility arises which must be carried out by the Head of the Bangkalan Regency Land Office after the stipulation in PTUN Surabaya Decision Number 169 G 2018 PTUN.SBY Year 2019.The research method in this thesis is normative juridical by analyzing the systematic system of law which includes legal subjects, rights and obligations, legal actions, legal relations, and legal objects. This type of research used in this thesis is descriptive analytical research, to describe, describe, analyze, and analytically explain the problems raised. In the analysis of this case, it was discovered that there were administrative defects in the issuance of Village Ownership Certificate Number 00163 Desa Kel. Petapan. The Head of the Bangkalan Regency Land Office must cancel The Title Certificate and maintain registration data. The authors advise that the activities of announcing physical data be carried out in ways that are more effective and efficient and further enhance the prudence of the Land Office in carrying out their duties.
