Notaris merupakan Pejabat Umum yang berwenang untuk membuat akta autentik yang dalam melaksanakan tugas profesinya diawasi oleh Majelis Pengawas Notaris. Namun pada prakteknya seringkali Notaris tidak mengikuti ketentuan yang telah ditetapkan oleh undang-undang maupun tidak saksama sehingga terdapat pihak yang dirugikan. Pada penelitian tesis ini terdapat beberapa permasalahan yang dibahas yaitu (1) akibat hukum dari Berita Acara Rapat Umum Pemegang Saham yang dibuat berdasarkan surat kuasa; (2) tanggung jawab notaris terhadap akta yang dibuatnya; (3) kesesuaian sanksi yang diberikan oleh Majelis Pengawas Notaris dengan perbuatannya. Penelitian ini bersifat yuridis normatif. Tipe penelitian ini adalah deskriptif analitis. Berdasarkan hasil penelitian pada kasus Putusan Majelis Pengawas Pusat Notaris Nomor: 19/B/MPPN/VII/2019 yaitu Notaris harus memeriksa kewenangan dari para penghadap serta mengecek dokumen-dokumen yang diperlihatkan kepada Notaris. Untuk kasus tersebut implikasi hukumnya maka akta yang dihasilkan batal demi hukum. Sedangkan pertanggungjawaban Notaris atas akta yang dibuatnya dengan adanya pelanggaran adalah memberikan ganti rugi dan menerima sanksi pemberhentian sementara selama 3 bulan oleh Majelis Pengawas Pusat Notaris. Sedangkan. kesesuaian antara sanksi yang diberikan dengan kesalahan yang dilakukan oleh notaris adalah sanksi yang diberikan belum sesuai dengan kelalaian yang diberikan, karena Notaris hanya diberikan sanksi pelanggaran kode etik, namun untuk sanksi perdata pihak yang dirugikan yaitu Direktur utama dapat melanjutkan gugatan untuk di proses lebih lanjut ke Pengadilan agar Notaris yang bersangkutan dapat menerima sanksi sesuai dengan perbuatannya.

However, in practice, notaries often do not follow the provisions set out in the law or are not careful so that there are parties who are disadvantaged. In this thesis research, there are several issues discussed, namely (1) the legal consequences of the Minutes of the General Meeting of Shareholders which are made based on a power of attorney; (2) notary responsibility for the deed he made; (3) the suitability of sanctions given by the Notary Supervisory Board with their actions. This research is normative juridical. This type of research is analytical descriptive. Based on the results of research on the case of the Notary Central Board of Trustees Decision Number: 19 / B / MPPN / VII / 2019 namely the Notary must check the authority of the parties facing and check the documents shown to the Notary Public. In this case, the legal implications are that the resulting deed is null and void. Whereas the Notary's liability for the deed he made in the event of a violation is to provide compensation and receive a 3-month temporary suspension by the Notary Central Board of Trustees. While. suitability between sanctions given by mistakes made by a notary public is a sanction that has not been in accordance with the negligence given, because the Notary is only given a sanction of violation of the code of ethics, but for civil sanctions of the injured party, the President Director can proceed with the lawsuit for further processing to Court so that the Notary can receive sanctions in accordance with his actions.
