Skripsi ini membahas mengenai permasalahan monopoli penjualan bahan bakar pesawat jenis avtur yang dilakukan oleh PT Pertamina (Persero) di Indonesia berdasarkan hukum persaingan usaha. PT Pertamina (Persero) sebagai satu-satunya pelaku usaha dalam penjualan bahan bakar pesawat jenis avtur saat ini di Indonesia dianggap sebagai salah satu penyebab tingginya harga bahan bakar pesawat jenis avtur sehingga menimbulkan berbagai akibat dan permasalahan dalam aspek-aspek lain. Pokok permasalahan utama dalam skripsi ini adalah penjualan bahan bakar pesawat jenis avtur oleh PT Pertamina (Persero) di Indonesia ditinjau dari UU No. 5 Tahun 1999 serta akibat yang ditimbulkan dari penjualan bahan bakar pesawat jenis avtur oleh PT Pertamina (Persero) di Indonesia. Skripsi ini merupakan penelitian yuridis-normatif yang menggunakan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa struktur pasar penjualan bahan bakar pesawat jenis avtur di Indonesia berbentuk monopoli, tetapi tidak bertentangan dengan UU No. 5 Tahun 1999 karena tidak ditemukan adanya praktik monopoli dan/atau persaingan usaha tidak sehat. Namun, monopoli penjualan bahan bakar pesawat jenis avtur di Indonesia oleh PT Pertamina (Persero) sebaiknya disudahi dengan adanya pelaku usaha lain yang dapat bersaing dengan sehat agar tercipta harga yang lebih kompetitif. Sehingga, bahan bakar pesawat jenis avtur yang merupakan salah satu hasil pengolahan dari minyak bumi dapat memberikan kemakmuran dan kesejahteraan rakyat yang lebih maksimal sebagaimana yang diamanatkan dalam Pasal 33 UUD 1945.
This thesis discusses about the problem that occurs in monopoly of aviation turbine fuel selling by PT Pertamina (Persero) in Indonesia from the perspective of competition law. PT Pertamina (Persero) as the only seller of aviation turbine fuel in Indonesia is considered as the cause of high prices of aviation turbine fuel so that lead to impacts and problems in other aspects. The issues of this thesis are to discuss the aviation turbine fuel selling by PT Pertamina in Indonesia from the perspective of the law of the Republic of Indonesia No. 5 of 1999 and the impacts caused by aviation turbine fuel selling by PT Pertamina (Persero) in Indonesia. This thesis is the juridical-normative research using secondary data in the form of primary, secondary, and tertiary legal material. The result of the research shows that the structure of aviation turbine fuel selling in Indonesia is a monopoly, but it doesn’t infringe Law of the Republic of Indonesia No. 5 of 1999 because there is no monopolistic practices and unfair business competition. However, monopoly on aviation turbine fuel selling by PT Pertamina in Indonesia should be ceased by presenting another seller so that there is fair business competition and more competitive prices. So that, aviation turbine fuel as one of the results of crude oil’s processing can be exploited to the greatest benefit of the people as mandated in Article 33 of the Constitution of the Republic of Indonesia of 1945.
