ABSTRAK
Tesis ini menguraikan tentang aspek hukum pencatatan perkawinan di kantor catatan sipil bagi pasangan yang salah satunya telah meninggal dunia didasari dengan kasus konkrit berdasarkan putusan pengadilan Nomor 1018/Pdt.P/2018/PN.JKT.SEL. Pencatatan Perkawinan merupakan salah satu syarat sahnya perkawinan khususnya agar suatu perkawinan dapat diakui menurut hukum Negara Republik Indonesia. Proses Pencatatan Perkawinan oleh Pegawai Pencatatan Sipil diatur dalam Peraturan Pemerintah No. 9 Tahun 1975. Namun pada tahun 2018 terdapat kasus pencatatan perkawinan bagi pasangan yang salah satunya telah meninggal dunia. Hal ini merupakan suatu permasalahan hukum atas keabsahan dan kekuatan hukum penetapan hakim atas perintah untuk pencatatan perkawinan semacam ini. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai keabsahan pencatatan perkawinan bagi pasangan yang salah satunya telah meninggal dunia; dan kewenangan serta kekuatan hukum penetapan pengadilan untuk memerintahkan kantor catatan sipil dalam mencatatkan perkawinan ini. Untuk menjawab permasalahan ini digunakan metode penelitian yuridis normatif dengan pendekatan analitis. Tipe dan Bentuk Penelitian adalah Deskriptif dan analisa data dilakukan secara kualitatif. Hasil penelitian adalah menjawab bahwa pencatatan perkawinan di kantor catatan sipil bagi pasangan yang salah satunya telah meninggal dunia adalah dapat dilakukan, serta hakim berwenang untuk mengeluarkan penetapan perintah untuk mencatatkan perkawinan berdasarkan Pasal 36 UU No. 23 Tahun 2006.

ABSTRACT
This thesis describes the legal aspects of marriage registration at the civil registration office for a couple that one of whom has died based on a verdict No. 1018/Pdt.P/2018/PN.JKT.SEL. Marriage Registration is one of the legal requirements for a marriage, so that a marriage could be recognized according to the law of the Republic of Indonesia.. The Marriage Registration Process by Civil Registration Office is written in Government Regulation No. 9 of 1975. But in 2018, there was a case of marriage registration for a couple that one of whom had passed away. This could be seen as a legal problem especially about the validity and about the legal force of the judge provision to registry the marriage. This issues raised regarding the validity of marriage registration for couples, one of whom has passed away; and the authority and legal force of a corut to give order for the civil registration office to register this marriage. To answer this problem,this thesis will use normative juridical research methods with analytical approaches. Data analysis is descriptive analytic.this thesis answes that the registration of marriages in the civil registration office for one of whom has passed away could be done, although the law does not regulate this matter, as well as the judge has the authority to order the civil registration office to register this marriage as stipulated in Article 36 of Law No. 23 of 2006. However, in giving decision the judge needs to consider well because this kind of marriage registration didn't follow the procedure written in Article 10 and Article 11 GR No. 9 of 1975 that require the presence of the bride and groom in order to resgister the marriage.
