ABSTRAKTingginya kasus tawuran di Polres Jakarta Barat membutuhkan
penyelesaian yang mengedepankan pendekatan yang bersifat win-win solution sehingga dapat memperbaiki hubungan antar para pihak yang bersengketa di masyarakat, Salah satu pendekatan adalah dengan mediasi yang merupakan implementasi dari restorative justice. Tujuan penelitian ini adalah menganalisis pengaruh legitimasi kepolisian, kepercayaan masyarakat dan keterlibatan pemuda dalam pelaksanaan mediasi.. Jenis penelitian ini adalah observasional analitik dengan pendekatan waktu cross sectional. Populasi penelitian kelompok pemuda dengan teknik sampling Cluster Random Sampling. Tempat penelitian wilayah hukum Polres Jakarta Barat dengan variabel eksogen adalah legitimasi kepolisian, peran masyarakat, dan keterlibatan pemuda. Variabel endogen respon masyarakat meliputi penerapan mediasi dan pencegahan tawuran. Pengumpulan data menggunakan kuesioner tertutup.analisis menggunakan analisis jalur (Path analisys). Hasil penelitian bahwa legitimasi kepolisian, peran serta masyarakat
dan pemuda berpengaruh pada penerapan mediasi di Polres Jakarta Barat dalam pencegahan tawuran. Respon kepercayaan masyarakat menjadi variabel dominan dari ketiga variabel diikuti oleh legitimasi dan peran pemuda dalam penerapan mediasi pencegahan tawuran. Selain itu Mediasi juga sangat berpengaruh bagi pencegahan tawuran. Penemuan baru penelitian adalah pencegahan tawuran bisa menggunakn mediasi yakni peran serta masyarakat sebagai untuk menumbuhkan kepercayaan dan legitimasi kepada intitusi kepolisian agar mau terlibat dalam upaya pencegahan tawuran. Guna mencegah kasus tawuran berulang dengan pelaku-pelaku yang sama maka pendekatan yang lebih humanis yang saling menguntungkan baik korban maupun pelaku, polisi bisa menjalankan peran sebagai mediator untuk melakukan mediasi. Dan memaksimalkan peran pemuda untuk terlibat dalam pencegahan dan juga penyediaan fasilitas untuk mereka.
ABSTRACTHigh fight cases in West Jakarta Police require solutions that prioritize winwin solutions so as to improve relations between parties who are disputing in the community. One approach is mediation which is the implementation of restoration justice. The purpose of this study is to analyze the public response to the application of mediation by the West Jakarta Police in an effort to prevent contention from the restorative justice approach.This type of research is observational analytic with cross sectional time approach. The study population is a group of youth who use cluster random sampling techniques. The location of the West Jakarta Police Area research with exogenous variables which are legitimation, community response include youth's trust in the role of the police in mediation. Endogenous variables of mediatoan and prevention efforts to prevent fights. Data collection using a closed questionnaire. The analysis uses Path Analisys.The results of the study show that the legitimacy of the police force, the role of community and youth has a positive effect on the application of mediation in West Jakarta Police in preventing brawl. Public trust responses become the
dominant variable of the three variables followed by the legitimacy and role of youth in the application of mediation to prevent brawl. Besides mediation is also very influential in preventing brawl. The new research finding is that brawl prevention can use mediation, which is the role of the community as a way to foster trust and legitimacy to police institutions so that they are willing to engage in brawl prevention efforts. To prevent cases of repeated fights with the same perpetrators, a more humanistic approach that benefits victims and perpetrators, the police can play the role of mediators to mediate. And maximize the role of youth to be involved in prevention and also facilitiesfor them.
