Dalam Pelaksanaan Penjaminan Pemerintah untuk Pinjaman Langsung BUMN berdasarkan ketentuan yang diatur di dalam Peraturan Presiden Nomor 82 Tahun 2015 dengan Peraturan pelaksanaannya yaitu PMK No. 189 Tahun 2015 dan PMK No. 101 Tahun 2018 ditemukan beberapa permasalahan antara lain disharmoni norma antara Perpres No. 82 Tahun 2015 dengan peraturan pelaksananya, perbedaan norma dalam studi kelayakan untuk penjaminan pemerintah dengan penjaminan bersama pemerintah dan BUPI serta tidak diaturnya klausul negosiasi dalam peraturan perundang-undangan namun permasalahan tersebut tidak menyebabkan terhambatnya pelaksanaan penjaminan. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif (legal research) melalui pendekatan peraturan perundang-undangan (statute approach) dan didukung oleh data yang diperoleh melalui wawancara. Berdasarkan hasil penelitian yang telah dilakukan, Disharmoni norma terjadi sebagai wujud kompromi pemerintah atas keinginan Lembaga Keuangan Internasional agar penjaminan dapat terlaksana, Pemerintah tetap memberikan standar penilaian kelayakan yang sama terhadap penjaminan dan penjaminan bersama pemerintah dan BUPI serta negosiasi atas perjanjian penjaminan dilakukan walaupun proses negosiasi perjanjian penjaminan tidak diatur di dalam peraturan perundang-undangan karena kedua hal tersebut dianggap penting dalam pelaksanaan penjaminan. Untuk itu, pemberian jaminan harus disusun berdasarkan konsep pengelolaan fiskal pemerintah yang prudent dan perlunya revisi peraturan perundangan terkait agar tidak menimbulkan konflik norma dan dapat memberikan kepastian hukum

In the implementation of Government Guarantee for BUMN Direct Loans based on the provisions stipulated in Presidential Regulation Number 82 of 2015 with its implementing regulations, namely PMK No. 189 of 2015 and PMK No. 101/2018 found several problems, including disharmony of norms between Presidential Decree No. 82 of 2015 with its implementing regulations, differences in norms in the feasibility study for government guarantees with joint guarantees with the government and BUPI and the absence of negotiation clauses in the legislation but these problems do not cause obstruction of the implementation of the guarantee. The method used in this research is the normative juridical method (legal research) through the statute approach and is supported by data obtained through interviews. Based on the results of the research that has been done, the Disharmony of norms occurs as a form of government compromise on the wishes of the International Financial Institution so that the guarantee can be carried out, the Government continues to provide the same standard of feasibility assessment of guarantees and guarantees with the government and BUPI and negotiations on the guarantee agreement are carried out even though the agreement negotiation process is not stipulated in the government regulations, because these two things are considered important in the implementation of guarantee. For this reason, the provision of guarantees must be prepared based on the concept of prudent government fiscal management and the need for revision of relevant laws and regulations so as not to cause conflict of norms and to provide legal certainty.
