Dalam pelangsungan perkawinan poligami kerap ditemukan pelanggaran, yaitu dilangsungkan tanpa adanya izin isteri dan izin Pengadilan. Tesis ini membahas mengenai pencabutan gugatan pembatalan perkawinan poligami oleh isteri pertama berdasarkan Penetapan Pengadilan Agama Jakarta Utara Nomor 365/Pdt.G/2019/PA.JU. Permasalahan yang dibahas yaitu bagaimana akibat hukum pencabutan gugatan pembatalan perkawinan oleh isteri pertama terhadap perkawinan poligami yang dilangsungkan dengan penipuan dan pembagian harta bersama suami dengan isteri-isteri setelah suami meninggal dunia. Penelitian ini menggunakan metode penelitian yuridis normatif dengan tipe penelitian preskriptif. Hasil penelitian ini adalah perkawinan poligami yang dilangsungkan sah karena tidak bertentangan dengan rukun dan syarat perkawinan. Terkait pembagian harta bersama dapat diselesaikan secara litigasi maupun nonlitigasi. Penyelesaian secara litigasi dapat dikuatkan dengan akta van dading atau akta perdamaian yang mempunyai kekuatan hukum mengikat layaknya putusan Pengadilan. Terkait penyelesaian nonlitigasi dibuat dengan kesepakatan perdamaian yang dibuat oleh notaris yang kemudian didaftarkan ke Pengadilan agar kesepakatan perdamaian notariil tersebut mempunyai kekuatan hukum tetap dan mempunyai kekuatan eksekutorial. Mengenai besarnya bagian harta bersama suami dan setiap isteri dapat dibagi menggunakan metode bagi rata antara suami dengan isteriisteri dan metode ratio lama perkawinan.
