Indonesia merupakan negara yang sangat amat beragam dan kaya akan sumber daya hatinya. Bahkan, Indonesia merupakan negara megabiodiversity terbesar kedua di dunia setelah Brazil. Akan tetapi, hingga saat ini peneliti Indonesia masih belum bisa menjadi pionir dalam bidang bioteknologi. Teknologi di Indonesia yang sangat tertinggal menjadi salah satu penyebab utama Industri bioteknologi sulit untuk bisa berkembang. Selama ini, Indonesia masih bergantung dengan negara luar dalam memanfaatkan sumber daya genetik yang menggunakan bioteknologi modern. Akibatnya Indonesia selama ini hanya menjadi negara penyedia sumber daya genetik untuk dimanfaatkan dan diolah bioprospektor asing. Permasalahan lain yang menyebabkan sulit berkembangnya bioprospeksi ialah masih terjadi praktek biopiracy di Indonesia. Peran dari pemerintah dalam mengatasi permasalahan ini dan mendorong proses bioprospeksi untuk perkembangan industri bioteknologi di Indonesia sangatlah penting. Maka dari itu, diperlukan kerangka hukum yang ideal untuk bisa memajukan bioprospeksi oleh bioprospektor Indonesia dalam membangun industri bioteknologi yang mandiri.

The role of the government in overcoming these problems and encouraging the bioprospection process for the development of the biotechnology industry in Indonesia is very important. Therefore, an ideal legal framework is needed to promote bioprospection by Indonesian bioprospectors in building an independent biotechnology industry.
