Penelitian ini membahas keabsahan akta jual beli dibawah tangan dan proses pendaftaran tanah yang berkaitan dengan pesertipikatan tanah. Jual beli hak atas tanah merupakan salah satu cara peralihan hak atas tanah dalam masyarakat. Permasalahan dalam penelitian ini adalah keabsahan akta jual beli dibawah tangan atas benda tidak bergerak dan proses penerbitan sertipikat pengganti hak atas tanah yang hilang. Metode penelitan tesis ini berbentuk yuridis normatif, menggunakan studi dokumen berupa penelusuran terhadap data sekunder. Analisis dilaksanakan dengan pendekatan kualitatif. Hasil penelitian mengungkapkan bahwa perjanjian jual beli hak atas tanah dengan akta dibawah tangan adalah sah, walaupun tidak memiliki kekuatan pembuktian yang kuat dan penerbitan sertipikat pengganti hak atas tanah yang hilang dengan dilaksanakannya pengurusan penerbitan sertipikat pengganti hak atas tanah yang hilang ke Kantor Pertanahan dengan mengajukan permohonan dan mengacu pada peraturan perundang-undangan yang mengaturnya.

The research discusses the validity of the underhand sale and purchase deed and the land registration process related to land certification. The sale and purchase of land rights is one way of transferring land rights in the community. The problem in this research is the validity of the underhand sale and purchase deed of immovable objects and the process of issuing certificates to replace lost land rights. This thesis research method is in the form of normative juridical, using document study in the form of tracing of secondary data. The analysis was carried out with a qualitative approach. The results of the research reveal that the sale and purchase agreement of land rights with underhand deeds is legal, although it does not have strong evidentiary power and the issuance of certificates to replace land rights lost is carried out by carrying out the issuance of certificates to replace lost land rights to the Land Office by filing application and refers to the laws and regulations that govern it.
