Mengenai pembagian harta dari adanya perkawinan merupakan sesuatu hal yang sangat sensitif karena adanya proses perceraian. Faktor dari pihak suami maupun istri akan mempermasalahkan prihal harta gono-gini atau dikenal dengan harta bersana pada saat masih berstatus kawin. Karena selama masa ikatan perkawinan banyak pihak suami istri berfokus untuk mengumpulkan harta tersebut, dalam artian memenuhi kebutuhan yang akan datang, namun apabila telah terjadinya perceraian maka suami istri itu pula yang akan mempermasalahkan harta yang telah dikumpulkan ini. Berdasarkan Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan telah dijelaskan pula prihal pembagian harta bersama itu, namun dalam hal ini dijelaskan bahwa apabila pihak suami-istri tersebut telah berpisah secara negara tetap dijelaskan jika harta atau suatu objek yang dibeli pada saat masih dalam berstatus perkawinan maka objek tersebut menjadi harta bersama, dan dapat dibuktikan pada saat transaksi jual beli tersebut dibuat atas nama siapa. Sehingga dengan begitu dapat kita lihat pula objek yang termasuk dalam harta bersama atau tidak. Dalam hal ini terlihat jelas apabila adanya salah satu pihak yang berniat ingin merugikan pihak lain, maka tidak akan bisa, karena akan tunduk pada aturan yang berlaku dan dengan beberapa bukti pendukung. Sehingga dapat disimpulkan bahwa apabila tetap ada salah satu pihak merasa dirugikan prihal harta bersama ini maka pihak yang merasa dirugikan tersebut dapat mengajukan kembali pada pengadilan setempat.
