Tesis ini meneliti mengenai perlindungan Notaris sebagai pemegang protokol terhadap kerahasiaan akta yang ada di dalam penyimpanannya serta kewenangan dan tanggung jawab terhadap pemberian salinan Akta. Dalam tesis ini, Pemegang Protokol Notaris digugat untuk memberikan salinan akta oleh bukan para pihak yang ada di dalamAkta. Sehingga Notaris Pemegang Protokol dalam menjalankan jabatannya diperlukan Perlindungan hukum untuk memenuhi pemanggilan dan pemeriksaan jika terjadisengketa-sengketa hukum karena penerima protokol hanya menerima peralihan protokol guna menjaga minuta/surat-surat yang dilekatkan pada minuta atau protokol dalampenyimpanan Notaris serta untuk tetap menjaga keluhuran harkat dan martabat jabatannya, termasuk kesaksian dan berproses dalam pemeriksaan dan persidangan. Penelitian ini merupakan penelitian yuridis normatif dengan tipe penelitian deskriptif analitis dan dianalisa dengan metode kualitatif. Hasil dari penelitian ini adalahperlindungan hukum yang dapat diberikan kepada Notaris yang berasal dari Undangundang yakni Notaris dapat menggunakan hak ingkar Notaris apabila Notaris dimintaiketerangannya dalam proses peradilan, serta tanggung jawab dan kewenangan pemegang protokol Notaris sebagai penerima protokol bukan pembuat Akta, tanggung jawabnyahanya sebatas administratif yakni merawat minuta akta dan menyimpan protokol Notaris di tempat penyimpanannya, karena protokol Notaris tersebut telah diamanahkan dan telah beralih tanggung jawabnya untuk memelihara dan menjaganya. Selain itu mempunyai kewajiban untuk memberikan salinan Akta sesuai dengan ketentuan Pasal 54 Undang- Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris yang telah diubah dengan Undang-Undang Nomor 2 Tahun 2014.

Notary protocol holder as the recipient of the protocol not the Deed maker. it is only limited administratively, namely maintaining the Minuta deed and keeping the Notary's protocol in its storage, because the Notary's protocol has been mandated and has shifted its responsibility to maintain and safeguard it. In addition, it has the obligation to provide a copy of the Deed in accordance with the provisions of Article 54 of Law Number 30 of 2004 concerning the Position of Notary which has been amended by Law Number 2 of 2014.
